Plano Lemon Law Basics
In Plano, as anywhere else in Texas, a lemon law claim is brought under Tex. Occ. Code §2301.601 to §2301.613. The statute covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles), but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. In Texas the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service, as long as the claim is brought within the deadline in step 3. Court and Venue in Plano
Parts of Plano lie in Collin County and Denton County, per the 2020 Census. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists numbered district courts: 15 for Collin County and 12 for Denton County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.
