Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

El Paso Lemon Law Basics
An El Paso car is judged against Texas's statute, Tex. Occ. Code §2301.601 to §2301.613, and that law covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles). So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Texas Lemon Law Attorneys page.
How an El Paso Lemon Law Claim Works
This is what happens after you call us from El Paso.
Document Your Repairs
Keep every repair order from your El Paso dealership, even the short ones. TX lemon law needs written proof of each repair attempt, and those papers are the proof.
Free Case Evaluation
We read your repair history against the Texas statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including any written notice to the manufacturer that TX law requires. We deal with the manufacturer for you.
You Get Compensated
The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your El Paso Car a Lemon? Texas's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Texas law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Texas cases:
- ⚠️2024 Cadillac Lyriq: Recurring blank display/IPC screen
- ⚠️2024 Cadillac Lyriq: Autonomous emergency braking in rain
- ⚠️2024 Cadillac Lyriq: A/C compressor bracket twisted
- ⚠️2024 Cadillac Lyriq: ABS warning and battery discharge
Have You Met the Repair Attempt Threshold?
In Texas the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Texas the deadline is 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery. We check it against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in El Paso
El Paso is in El Paso County. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists 16 numbered district courts for El Paso County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.
The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset).

Texas Lemon Law: The Rules That Decide an El Paso Claim
Some Texas rules sit outside the repair test, the arbitration rule and the deadline, which you can find under Court and Venue above. Those other rules are here.
Notable provisions of Texas Lemon Law
Texas uses a state-administered complaint process through TxDMV (not traditional arbitration). Only 2 repair attempts needed for serious safety hazards. Texas also covers towable recreational vehicles (RVs). The TxDMV filing fee is $35, and the other side pays it back if the consumer wins.

What The Manufacturer Owes You
By statute, the Texas remedy is replacement vehicle or full refund (minus reasonable use offset). When an El Paso car qualifies under TX law, the case usually ends in one of three ways.
Refund
The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.
Replacement Vehicle
Instead of money you get a comparable new car, and the swap costs you nothing.
Cash Settlement
The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.
