Garland Lemon Law

Garland Lemon Law Basics

Garland drivers file under Texas's statute, Tex. Occ. Code §2301.601 to §2301.613. If the dealer can't fix a warranty defect after 4 repair attempts for the same defect (or 2 for serious safety defects), or the car sits in the shop for 30 cumulative days, you can ask for a refund, a replacement or a cash payment. The manufacturer can also be ordered to pay your attorney's fees. Statute text, filing deadlines and how used cars are treated are on our Texas Lemon Law Attorneys page.

Is Your Garland Car a Lemon? Texas's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

The defect must materially affect how you drive, how much your vehicle is worth, or how safe it is to operate. In Garland, common qualifying defects include:

  • ⚠️TRANSMISSION PROBLEMS from heavy congestion on I-635 and I-30 during Dallas metro commuting through eastern Dallas County
  • ⚠️AC COMPRESSOR BREAKDOWN from 106°F North Texas summers while idling in LBJ Freeway traffic through Garland
  • ⚠️ELECTRICAL SYSTEM FAILURE from severe thunderstorms and hail that pound the I-30 corridor through eastern Dallas County
  • ⚠️SUSPENSION DAMAGE from rough I-30 pavement and potholed city streets in older Garland neighborhoods near Downtown
2

Have You Met the Repair Attempt Threshold?

Texas's Lemon Law triggers when any of these conditions are met, so long as you bring your claim within 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery:

4️⃣ 4 repair attempts for the same defect (or 2 for serious safety defects) at an authorized dealership
2️⃣ 2 repair attempts for a defect that could cause serious bodily injury or death
📅 30 cumulative days out of service for any combination of defects
3

Did It Happen Within the Rights Period?

The clock starts on the day you take delivery of your vehicle, not when you first report the defect, not when you file a complaint. Under Texas law, a claim must generally be brought within 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery. If you're still within that window, or if your defect first appeared within the window and persists, you almost certainly qualify.

When in doubt, call. The consultation is always free. 📞 (855) 435-3666

Garland Driving Environment

Garland Driving Conditions & Why Defects Emerge Here

Garland's intense heat and humidity combination is one of the most punishing vehicle environments in America. Here is how local conditions contribute to defects.

🗺️ Local Driving Demands

Garland drivers navigate demanding corridors including I-30, I-635, US-78 (Lavon Drive), and TX-190 (Bush Turnpike) daily. Higher mileage from daily commuting influences the usage offset in lemon law claims. The earlier you report defects, the lower your offset and the stronger your case.

🌉 The Bridge Factor

The major bridge and highway infrastructure including the Duck Creek Bridge on I-30 and the I-635/I-30 interchange overpass create load profiles that expose transmission hesitation and engine defects flat-road driving conceals. Clients report vehicles that "drive fine on flat roads" but exhibit problems under load.

🌡️ Heat & Humidity Damage

Garland's combination of high heat and humidity creates a punishing environment for vehicles. Moisture infiltrates electrical connections causing intermittent faults, HVAC systems run under extreme load, and heat cycles stress engine gaskets and seals.

🌡️ Sustained Heat & Humidity

Garland's prolonged heat and humidity create sustained stress on HVAC compressors, cooling systems, and electrical wiring. Moisture-driven corrosion accelerates component failure faster than in dry climates. Texas's Lemon Law recognizes these failures as a substantial impairment.

🚗 Heavy Commuter Traffic

Garland's major traffic corridors including I-30, I-635, US-78 (Lavon Drive), and TX-190 (Bush Turnpike) create heavy stop-and-go conditions that stress transmission fluid temperatures, cooling systems, and hybrid/EV battery management. These could qualify as lemon law defects.

Frequently Asked Questions

Everything you need to know about filing a lemon law claim in Garland, Texas.

PROCESS & TIMELINE
Every repair order from your Garland dealership, the purchase or lease contract and the warranty booklet. Under Tex. Occ. Code §2301.601 to §2301.613 the claim rests on those repair orders: 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service. The Texas filing deadline is within 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery.
Most lemon law cases we handle for Garland drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Texas rule is: complaint must be filed with the Texas Department of Motor Vehicles (TxDMV) which conducts a hearing. We prepare that filing for you.
ELIGIBILITY
Under Tex. Occ. Code §2301.601 to §2301.613, your car may qualify if a warranty-covered defect survives 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service. The statute covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles).
Tex. Occ. Code §2301.601 to §2301.613 covers a nonconformity: a defect that substantially impairs the use, market value or safety of the vehicle and that survives 4 repair attempts for the same defect (or 2 for serious safety defects), or keeps the car out of service for 30 cumulative days. It applies to new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles). One Texas-specific point: Texas uses a state-administered complaint process through TxDMV (not traditional arbitration). The defects we file most often for Texas drivers are engine stalling and misfires, transmission shudder or failure, electrical faults that leave warning lights on, brake and steering problems, and driver-assistance (ADAS) systems that brake or drift on their own.
REMEDIES
Under Tex. Occ. Code §2301.601 to §2301.613, the statutory remedy is replacement vehicle or full refund (minus reasonable use offset). Which one applies depends on your repair history and the manufacturer.
ATTORNEY & TRUST
Nothing upfront and no hourly bills. We work on contingency, so there is no attorney's fee unless we recover for you. In Texas, the manufacturer pays the consumer's attorney's fees when the consumer wins. That is why most Texas claims that succeed end with the manufacturer, not the driver, covering our fee. Repair orders come from the dealer for free, and we cover filing costs while the matter is open. If your car qualifies under Tex. Occ. Code §2301.601 to §2301.613 (4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service), the money at stake is the remedy itself, replacement vehicle or full refund (minus reasonable use offset). Bring the repair orders to the free case review and we will tell you which of those remedies fits.

What Our Clients Are Saying

Easy Lemon has handled 1,500+ lemon law matters, recovering over $30 million** for clients.

My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.

My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.

I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.
