Texas's lemon law, Tex. Occ. Code §2301.601 to §2301.613, is the one that applies in Fort Worth. Have You Met the Repair Attempt Threshold?

In Texas the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.

Texas trial courts

Court and Venue in Fort Worth

Parts of Fort Worth lie in Denton County, Johnson County, Parker County, Tarrant County and Wise County, per the 2020 Census. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists numbered district courts: 12 for Denton County, 3 for Johnson County, 2 for Parker County, 24 for Tarrant County and 1 for Wise County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.

The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset).

What The Manufacturer Owes You
