Killeen Lemon Law

Killeen Lemon Law Basics

A Killeen car is judged against Texas's statute, Tex. Occ. Code §2301.601 to §2301.613, and that law covers new motor vehicles purchased or leased in Texas for personal, family, or household use; Texas also covers towable recreational vehicles. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Texas Lemon Law Attorneys page.

Step by Step

How a Killeen Lemon Law Claim Works

This is what happens after you call us from Killeen.

1

Document Your Repairs

Keep every repair order from your Killeen dealership, even the short ones. Under Texas's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Texas statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice of the defect to the manufacturer, converter, or distributor that Texas law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Killeen Car a Lemon? Texas's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Texas law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Texas cases:

  • ⚠️2024 Cadillac Lyriq: Recurring blank display/IPC screen
  • ⚠️2024 Cadillac Lyriq: Autonomous emergency braking in rain
  • ⚠️2024 Cadillac Lyriq: A/C compressor bracket twisted
  • ⚠️2024 Cadillac Lyriq: ABS warning and battery discharge
2

Have You Met the Repair Attempt Threshold?

In Texas the test is 4 repair attempts for the same defect (2 for serious safety defects) or 30 cumulative days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Texas, the claim must be started within 6 months after the earliest of the express warranty expiring, 24 months, or 24,000 miles from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Bell County

Court and Venue in Killeen

Killeen is in Bell County. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists 6 numbered district courts for Bell County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.

The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use.

What the Statute Says

Texas Lemon Law: The Rules That Decide a Killeen Claim

Beyond the repair test and the arbitration rule, which are both in Court and Venue above, Texas law has some provisions of its own.

Notable provisions of Texas Lemon Law

Texas uses a state-administered complaint process through TxDMV, not traditional arbitration. Only 2 repair attempts are needed for serious safety hazards. Texas also covers towable recreational vehicles (RVs). The TxDMV filing fee is $35, and the other side pays it back if the consumer wins.

Your Rights Under Texas Law

What The Manufacturer Owes You

Under the statute, the remedy open to Texas drivers is a replacement vehicle or a full refund, minus a reasonable offset for use. If your Killeen car qualifies, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Texas law and on the paperwork Killeen drivers usually send us.

PROCESS & TIMELINE
Most of the Texas cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Texas, the claim must be started within 6 months after the earliest of the express warranty expiring, 24 months, or 24,000 miles from original delivery.
Bring the repair orders from your Killeen dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
Tex. Occ. Code §2301.601 to §2301.613 covers new motor vehicles purchased or leased in Texas for personal, family, or household use. Texas also covers towable recreational vehicles. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
REMEDIES
Under Tex. Occ. Code §2301.601 to §2301.613, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
The Texas Lemon Law has no attorney-fee provision of its own. A consumer who wins the TxDMV case gets the $35 filing fee back. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) provides a fee-shifting route of its own when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Tex. Occ. Code §2301.601 to §2301.613. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Texas law. In Texas, the complaint must be filed with the Texas Department of Motor Vehicles (TxDMV), which holds a hearing. This is a state-administered process, not traditional arbitration.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡, recovering over $50 million** for clients.

star star star star star
“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
