Austin Lemon Law Basics
The law that applies in Austin is Texas's lemon law, Tex. Occ. Code §2301.601 to §2301.613, and it covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles). You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. Under Texas law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Texas cases:

Have You Met the Repair Attempt Threshold?
In Texas the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.

In Texas the deadline is 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery. We check it against the delivery date on your contract and the dates on your repair orders.

Court and Venue in Austin
Parts of Austin lie in Bastrop County, Hays County, Travis County and Williamson County, per the 2020 Census. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists numbered district courts: 4 for Bastrop County, 6 for Hays County, 21 for Travis County and 7 for Williamson County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.
The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset).

What The Manufacturer Owes You
Texas law provides for replacement vehicle or full refund (minus reasonable use offset). There are three ways a qualifying case from Austin usually ends under TX law.
Refund
Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.
Replacement Vehicle
The manufacturer hands you a comparable new car and pays the cost of the exchange.
Cash Settlement
The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.
