Common Defects That Make Your Car an Easy Lemon

If your car is spending more time in the shop than on the road, Lemon Law may protect you. Each of the four problems below comes from a case we have closed.

Repeated Transmission Failures

The car slips out of gear, shifts hard or late, or lurches when you pull away from a light. A GMC Sierra in Colorado with a severe transmission failure spent 82-plus days in the shop before the claim settled. Several repair attempts for the same transmission problem can qualify your vehicle for Lemon Law protection.

Ongoing Electrical Issues

The car is hard to start, the battery keeps dying, or warning lights come on that the dealer can't explain. A 2024 Chevrolet Silverado in Florida made three repair visits for electrical, camera and safety-system failures and was out of service for 90-plus days. If the same electrical fault keeps coming back after repairs, the car may qualify under Lemon Law.

Safety System Failures

Airbag, brake or sensor failures can make a car unsafe to drive. A 2024 Tesla Cybertruck in New York lost brake pressure and went through five repair visits before the manufacturer bought it back. Some states need fewer repair attempts for a serious safety defect. In New Jersey it is one, and in Texas it is two.

Engine Problems

The engine stalls, overheats or misfires. A 2025 Toyota Tundra leased in North Dakota needed a complete short block replacement after an engine misfire and sat for 135 days, and that lease ended in a buyback. An engine that fails again after several repair attempts may qualify the car as a lemon.

Lemon Law vs. Warranty: Key Differences to Know

A warranty only promises that the manufacturer will try to repair the car, and a lot of drivers find out after several trips to the dealer that the repairs don't always work. Lemon Law picks up at that point. When repairs keep failing, it gives you a claim for a refund, a replacement vehicle, or a settlement.

Before you hire a lawyer, including us, ask a few direct questions and see how they answer.

Ask about the fee before you sign anything. Under the federal Magnuson-Moss Warranty Act, 15 U.S.C. 2301-2312, a consumer who prevails can recover attorney fees and costs from the manufacturer, and most state lemon laws have their own fee-shifting clause. That is why a lemon law firm has no reason to ask you for a retainer.

How many repair attempts does it take before a car is a lemon? +

It depends on the state where you bought or registered the car, because there is no single national number. New York (N.Y. Gen. Bus. Law §198-a) and Texas (Tex. Occ. Code §2301.605) both presume a car is a lemon after four repair attempts for the same defect. Pennsylvania (73 Pa. Stat. §1951) and New Jersey (N.J. Stat. §56:12-29) set the number at three. If the defect is a serious safety problem, New Jersey only needs one attempt and Texas needs two. A car can also qualify in those states on days out of service instead. The 2022 Porsche Cayenne we handled in Texas went through nine repair visits before Porsche bought it back. If you send us your repair orders, we can tell you which count your car is closer to and what else has to line up.

What counts as a day out of service? +

It is any day the car is at the shop for warranty work. The days add up across all of your visits, so they do not have to be in a row, and getting a loaner does not stop the count. New York, Texas, Pennsylvania and Florida all use 30 cumulative days. New Jersey uses 20, which is the shortest of the five states we file in most. Florida (Fla. Stat. §681.10 to §681.118) also requires you to notify the manufacturer in writing once the car reaches 15 cumulative days. The number can add up quickly. A 2024 Audi Q8 e-tron we handled in Texas was out of service for 166 days across three visits after its rear motor failed. Keep the paperwork from every visit, including any weeks when the car was waiting on a part.

Do I have to go through arbitration before I can sue? +

In some states you do, and it affects how we plan the case. In Florida, new car claims go to the state-run Florida New Motor Vehicle Arbitration Board, and in Texas they are handled as a complaint and hearing at the TxDMV. Pennsylvania and New York make you use the manufacturer's own dispute program first if it has one, and New York also has a state program you can choose. New Jersey has no requirement like this, so a consumer there can go straight to court. We figure out the right forum before anything is filed, since starting in the wrong one can cost months.

How long do I have to file a lemon law claim? +

Usually less time than people think, and each state has its own deadlines. New York's new car law covers defects reported in the first 2 years or 18,000 miles, whichever comes first, and a suit must be filed within 4 years of delivery. New Jersey allows 2 years or 24,000 miles. Pennsylvania has the shortest window of these states at 12 months, 12,000 miles, or the end of the express warranty. In Florida you get 60 days after the 24-month Lemon Law rights period closes, and in Texas you get 6 months after the earlier of warranty expiration or 24 months and 24,000 miles. A federal warranty claim may still be open after the state deadline passes, but the state lemon law claim will be gone by then. That is why we tell people to start the claim process early.

What does it cost to hire a lemon law attorney? +

You pay nothing out of your pocket. We work on contingency, and the lemon law statutes are set up for that. New York, New Jersey, Pennsylvania and Florida each require the manufacturer to pay the consumer's attorney fees when the consumer prevails, and Texas lets a consumer who prevails recover reasonable fees. The federal Magnuson-Moss Warranty Act does the same at 15 U.S.C. §2310(d)(2). On the 2025 Audi Q5 we handled in Connecticut, the client paid nothing out of pocket and the manufacturer covered the legal fees. Here is how the payment actually works.

My warranty already expired. Am I out of luck? +

Not necessarily. What matters is when the defect was first reported, and not when you called a lawyer. If a repair order shows the problem was reported while the written warranty was still in effect, the claim generally goes by those records. State filing deadlines still apply. Separately, the federal Magnuson-Moss Warranty Act (15 U.S.C. §2301 to §2312) covers a breach of written warranty on its own terms. Look for the oldest repair order you have, because its date usually answers the question.

Does the lemon law cover used cars? +

Sometimes, and this is where state laws differ the most. New York has a separate Used Car Lemon Law at N.Y. Gen. Bus. Law §198-b. New Jersey covers certain dealer-sold used vehicles under N.J. Stat. §56:12-29 and the sections that follow, but most other state statutes only cover new vehicles. Even in those states, a used car still inside the original factory warranty is covered by that warranty, and the federal act applies to it. Easy Lemon takes vehicles from model year 2022 or newer.

What is the Magnuson-Moss Warranty Act? +

It is a federal warranty statute, 15 U.S.C. §2301 to §2312, and it applies nationwide. A state lemon law counts repair attempts, while Magnuson-Moss asks whether the manufacturer honored the written warranty it sold you. It covers leased vehicles, used vehicles under warranty, and cars that fell outside a state deadline, and it shifts fees to the manufacturer under §2310(d)(2). When a state lemon law does not fit the facts, this is usually the statute we use for the car warranty claim.

Which documents actually decide my case? +

The repair orders decide most cases, because every count above is taken from them. The dates in and out, the mileage and the complaint the service writer typed are what matter. Bring those along with the purchase or lease agreement, the warranty booklet and any letter you sent the manufacturer, and include the visits where the shop found nothing. On a 2022 Jeep Wrangler we handled in South Carolina, four repair attempts, including a manufacturer recall repair, failed to fix the same steering wobble. If three repair orders describe the same defect in three different ways, tell us now rather than at a hearing.

What can I get if the claim succeeds? +

State law allows three outcomes. You can get a replacement vehicle, a refund of what you paid minus an offset for the miles you drove, or a cash settlement that lets you keep the car. New York and Texas are written around replacement or refund. New Jersey and Pennsylvania also allow a cash settlement, and Florida refunds the purchase price less a use offset.
