How to Choose a Lemon Law Attorney

Most drivers hire the first firm that answers the phone. A few questions up front tell you more than any advertisement will.

Before you sign anything, understand who pays the lawyer. Under the federal Magnuson-Moss Warranty Act, 15 U.S.C. 2301-2312, a consumer who prevails can recover attorney fees and costs from the manufacturer. Most state lemon laws carry the same kind of fee-shifting provision. That is why a real lemon law firm does not ask you for a retainer.

Frequently Asked Questions

How many repair attempts does it take before a car is a lemon? +
There is no single national number, and any site that hands you one is guessing. The count is set by the state where you bought or registered the car. New York (N.Y. Gen. Bus. Law §198-a) and Texas (Tex. Occ. Code §2301.605) both presume a lemon after four tries at the same defect. Pennsylvania (73 Pa. Stat. §1951) and New Jersey (N.J. Stat. §56:12-29) set it at three. New Jersey drops to one attempt for a serious safety defect; Texas drops to two. Each of those states also has a second route: days out of service. Send us the repair orders and we will tell you which count your car is closest to, and what else has to line up.
What counts as a day out of service? +
Any day the car sits at the shop for warranty work. Those days pile up across visits, they do not have to run back to back, and a loaner does not stop the clock. New York, Texas, Pennsylvania and Florida all use 30 cumulative days. New Jersey uses 20, the shortest of the five states we file in most. Florida (Fla. Stat. §681.10 to §681.118) adds a step: at 15 cumulative days you notify the manufacturer in writing. Keep the paperwork from every visit, including the weeks your car sat waiting on a part.
Do I have to go through arbitration before I can sue? +
In some states, yes, and it changes the plan. Florida routes new car claims to the state-run Florida New Motor Vehicle Arbitration Board. Texas handles them as a complaint and hearing at the TxDMV, which costs a consumer nothing to file. Pennsylvania runs a certified program through the Bureau of Consumer Protection. New York has its own arbitration program when the manufacturer takes part. New Jersey has no prerequisite at all, so a consumer can go straight to court. We check that first, because the wrong forum costs months.
How long do I have to file a lemon law claim? +
Less time than most people assume. New York's new car law runs 2 years or 18,000 miles from delivery, whichever comes first. New Jersey allows 2 years or 24,000 miles. Pennsylvania is the tightest of the group: 12 months, 12,000 miles, or the end of the express warranty. Florida gives you 60 days after the 24-month Lemon Law rights period closes. Texas gives 6 months after the earlier of warranty expiration or 24 months and 24,000 miles. Miss the state window and a federal warranty claim may still be open, but the direct route is gone. Start the claim process early.
What does it cost to hire a lemon law attorney? +
Nothing out of your pocket. We work on contingency, and the statutes are built for it. New York, New Jersey, Pennsylvania and Florida each direct the manufacturer to pay the consumer's attorney fees when the consumer prevails, and Texas lets a prevailing consumer recover reasonable fees. The federal Magnuson-Moss Warranty Act does the same thing at 15 U.S.C. §2310(d)(2). That fee-shifting is the reason a defective car case is worth bringing at all: the fee does not come out of your refund. Here is how the payment actually works.
My warranty already expired. Am I out of luck? +
Not automatically. What matters is when the defect was first reported, not when you got around to calling a lawyer. If a repair order documents the problem while the written warranty was still alive, the claim generally travels with those records. State filing deadlines still apply, and the federal Magnuson-Moss Warranty Act (15 U.S.C. §2301 to §2312) covers a breach of written warranty on its own terms. Find the oldest repair order in the glovebox. That date usually settles the question.
Does the lemon law cover used cars? +
Sometimes, and this varies more than any other piece of it. New York has a separate Used Car Lemon Law at N.Y. Gen. Bus. Law §198-b. New Jersey covers certain dealer-sold used vehicles under N.J. Stat. §56:12-29 and the sections that follow. Most other state statutes were written for new vehicles only. That is not the end of the analysis: a used car still inside the original factory warranty is covered by that warranty, and the federal act reaches it. Easy Lemon takes vehicles from model year 2022 or newer.
What is the Magnuson-Moss Warranty Act? +
A federal warranty statute, 15 U.S.C. §2301 to §2312, and it applies nationwide. It does not care how many repair attempts your state presumes. It asks one question: did the manufacturer honor the written warranty it sold you? It reaches leased vehicles, used vehicles under warranty, and cars that fell outside a state deadline, and it shifts fees to the manufacturer under §2310(d)(2). When a state lemon law does not fit the facts, this is usually the statute we build the car warranty claim on.
Which documents actually decide my case? +
Repair orders. Every presumption above is counted off them: date in, date out, mileage, and the complaint line the service writer typed. Bring the purchase or lease agreement, the warranty booklet, every repair order including the visits where the shop found nothing, and any letter you sent the manufacturer. One warning from experience. If three repair orders describe the same defect three different ways, that is an argument worth having now, not at a hearing.
What can I get if the claim succeeds? +
State law puts three outcomes on the table: a replacement vehicle, a refund of what you paid minus an offset for the miles you drove, or a cash settlement that lets you keep the car. New York and Texas are written around replacement or refund. New Jersey and Pennsylvania also allow a cash settlement. Florida refunds the purchase price less a use offset.
