Dallas Lemon Law

Dallas Lemon Law Basics

The law that applies in Dallas is Texas's lemon law, Tex. Occ. Code §2301.601 to §2301.613, and it covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles). You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Texas Lemon Law Attorneys page.

Step by Step

How a Dallas Lemon Law Claim Works

This is what happens after you call us from Dallas.

1

Document Your Repairs

Keep every repair order from your Dallas dealership, even the short ones. TX lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Texas statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that TX law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Dallas Car a Lemon? Texas's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Texas law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Texas cases:

  • ⚠️2024 Cadillac Lyriq: Recurring blank display/IPC screen
  • ⚠️2024 Cadillac Lyriq: Autonomous emergency braking in rain
  • ⚠️2024 Cadillac Lyriq: A/C compressor bracket twisted
  • ⚠️2024 Cadillac Lyriq: ABS warning and battery discharge
2

Have You Met the Repair Attempt Threshold?

In Texas the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Texas the deadline is 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Texas trial courts

Court and Venue in Dallas

Parts of Dallas lie in Collin County, Dallas County, Denton County, Kaufman County and Rockwall County, per the 2020 Census. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists numbered district courts: 15 for Collin County, 32 for Dallas County, 12 for Denton County, 3 for Kaufman County and 3 for Rockwall County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.

The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset).

What the Statute Says

Texas Lemon Law: The Rules That Decide a Dallas Claim

We covered the repair test, the arbitration rule and the deadline in the Court and Venue section above. Below are other Texas rules that can matter to a Dallas claim.

Notable provisions of Texas Lemon Law

Texas uses a state-administered complaint process through TxDMV (not traditional arbitration). Only 2 repair attempts needed for serious safety hazards. Texas also covers towable recreational vehicles (RVs). The TxDMV filing fee is $35, and the other side pays it back if the consumer wins.

Your Rights Under TX Law

What The Manufacturer Owes You

The Texas statute provides for replacement vehicle or full refund (minus reasonable use offset), and a qualifying TX case from Dallas usually ends in one of these three ways.

$

Refund

You hand back the car. In return the manufacturer repays the price, the taxes, the registration fees and the finance charges, with a reasonable use offset taken out.

Replacement Vehicle

You leave with a comparable new car. The manufacturer pays for the swap.

$

Cash Settlement

You keep the car, and the manufacturer pays you for the value the defect took off it. This result is not listed in the statute and comes from negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Texas law and on the paperwork Dallas drivers usually send us.

PROCESS & TIMELINE
Most of the Texas cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. The Texas filing deadline is within 6 months after the earliest of the express warranty expiration or 24 months/24,000 miles from original delivery.
Bring the repair orders from your Dallas dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under Tex. Occ. Code §2301.601 to §2301.613, your Dallas car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days out of service. The statute covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles).
Tex. Occ. Code §2301.601 to §2301.613 covers new motor vehicles purchased or leased in Texas for personal, family, or household use (also covers towable recreational vehicles). If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. Texas uses a state-administered complaint process through TxDMV (not traditional arbitration).
ATTORNEY & TRUST
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Tex. Occ. Code §2301.601 to §2301.613. Then written notice goes to the manufacturer, and we demand the statutory remedy, replacement vehicle or full refund (minus reasonable use offset). Most cases settle at that stage. If a case does not settle, we take the next formal step that Texas law requires.

What Our Clients Are Saying

Easy Lemon has handled 1,500+ lemon law matters‡, recovering over $30 million** for clients.

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”
