Court and Venue in Amarillo

Parts of Amarillo lie in Potter County and Randall County, per the 2020 Census. A Texas lemon law claim starts as a complaint to the Texas Department of Motor Vehicles (TxDMV), not as a lawsuit. For a warranty suit filed in court, district courts are the general trial courts in Texas, and the Texas Office of Court Administration lists numbered district courts: 5 for Potter County and 3 for Randall County. County courts at law can share that civil jurisdiction. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Texas lemon law is Tex. Occ. Code §2301.601 to §2301.613. TxDMV cannot order a refund or replacement unless the manufacturer received written notice of the defect and a chance to cure it (Tex. Occ. Code §2301.606(c)). The complaint must be filed with TxDMV, which holds a hearing.

The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use.

What The Manufacturer Owes You

What the manufacturer owes under Texas's statute is a replacement vehicle or a full refund, minus a reasonable offset for use. Most qualifying cases from Amarillo end in one of the three results below.

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.
