In Texas, the manufacturer pays the consumer's attorney's fees when the consumer wins. Tex. Occ. Code §2301.601 to §2301.613 is the statute a Texas court applies, and the federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached.
