Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

Allentown Lemon Law Basics
In Allentown, as anywhere else in Pennsylvania, a lemon law claim is brought under 73 Pa. Stat. §1951 to §1960. The statute covers new motor vehicles purchased, leased, or registered in Pennsylvania for personal, family, or household purposes, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Pennsylvania Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Is Your Allentown Car a Lemon? Pennsylvania's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Pennsylvania law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Pennsylvania the test is 3 repair attempts for the same defect or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Pennsylvania, the deadline under the statute is the first 12 months, 12,000 miles, or the express warranty period, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

Court and Venue in Allentown
Allentown is in Lehigh County. Lehigh County's general civil trial court is the Court of Common Pleas of Lehigh County, part of the Thirty-First Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Pennsylvania lemon law is 73 Pa. Stat. §1951 to §1960. If the manufacturer has a dispute program that follows federal FTC rules, the consumer must use it first, but its decision does not bind the consumer.
The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle, a full refund, or a cash settlement. Under the statute, a consumer who prevails can recover reasonable attorney fees from the manufacturer.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Pennsylvania Automobile Lemon Law: The Rules That Decide an Allentown Claim
Court and Venue above gives you the repair test and the arbitration rule. Pennsylvania law adds a few rules on top of those, and they follow.
Notable provisions of Pennsylvania Automobile Lemon Law
Pennsylvania requires 3 repair attempts. The law covers the shorter of 12 months, 12,000 miles, or the warranty period.

What The Manufacturer Owes You
By statute, the Pennsylvania remedy is a replacement vehicle, a full refund, or a cash settlement. When an Allentown car qualifies under Pennsylvania law, the case usually ends in one of three ways.
Refund
The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.
Replacement Vehicle
Instead of money you get a comparable new car, and the swap costs you nothing.
Cash Settlement
You keep the car, and the manufacturer pays for the value the defect took off it.
