Philadelphia Lemon Law

Philadelphia Lemon Law Basics

Claims from Philadelphia fall under 73 Pa. Stat. §1951 to §1960, which covers new motor vehicles purchased, leased, or registered in Pennsylvania for personal, family, or household purposes. If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Pennsylvania Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How a Philadelphia Lemon Law Claim Works

This is what happens after you call us from Philadelphia.

1

Document Your Repairs

Keep every repair order from your Philadelphia dealership, even the short ones. Under Pennsylvania's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Pennsylvania statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Philadelphia Car a Lemon? Pennsylvania's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Pennsylvania law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Pennsylvania the test is 3 repair attempts for the same defect or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Pennsylvania, the deadline under the statute is the first 12 months, 12,000 miles, or the express warranty period, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Philadelphia County

Court and Venue in Philadelphia

Philadelphia is in Philadelphia County. Philadelphia County's general civil trial court is the Court of Common Pleas of Philadelphia County, part of the First Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Pennsylvania lemon law is 73 Pa. Stat. §1951 to §1960. If the manufacturer has a dispute program that follows federal FTC rules, the consumer must use it first, but its decision does not bind the consumer.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle, a full refund, or a cash settlement. Under the statute, a consumer who prevails can recover reasonable attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Court and Venue above gives you the repair test and the arbitration rule. Pennsylvania law adds a few rules on top of those, and they follow.

Notable provisions of Pennsylvania Automobile Lemon Law

Pennsylvania requires 3 repair attempts. The law covers the shorter of 12 months, 12,000 miles, or the warranty period.

Your Rights Under Pennsylvania Law

What The Manufacturer Owes You

What the manufacturer owes under Pennsylvania's statute is a replacement vehicle, a full refund, or a cash settlement. Most qualifying cases from Philadelphia end in one of the three results below.

$

Refund

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.

Replacement Vehicle

You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.

$

Cash Settlement

You keep driving the car and the manufacturer pays you for the lost value.

Have Questions?

Frequently Asked Questions

The answers below are based on Pennsylvania law and on the paperwork Philadelphia drivers usually send us.

PROCESS & TIMELINE
Most of the Pennsylvania cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Pennsylvania, the deadline under the statute is the first 12 months, 12,000 miles, or the express warranty period, whichever comes first.
ELIGIBILITY
73 Pa. Stat. §1951 to §1960 covers new motor vehicles purchased, leased, or registered in Pennsylvania for personal, family, or household purposes. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
Under 73 Pa. Stat. §1951 to §1960, the remedy is a replacement vehicle, a full refund, or a cash settlement. Which one you get depends on your repair history and on what the manufacturer offers.
In Pennsylvania, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Pennsylvania cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in 73 Pa. Stat. §1951 to §1960 requires you to appear anywhere to open a claim.
