York Lemon Law

York Lemon Law Basics

Claims from York fall under 73 Pa. Stat. §1951 to §1960, which covers new motor vehicles purchased, leased, or registered in Pennsylvania for personal, family, or household purposes. If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Pennsylvania Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How a York Lemon Law Claim Works

This is what happens after you call us from York.

1

Document Your Repairs

Keep every repair order from your York dealership, even the short ones. Under Pennsylvania's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Pennsylvania statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your York Car a Lemon? Pennsylvania's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Pennsylvania law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Pennsylvania the test is 3 repair attempts for the same defect or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Pennsylvania, the deadline under the statute is the first 12 months, 12,000 miles, or the express warranty period, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

York County

Court and Venue in York

York is in York County. York County's general civil trial court is the Court of Common Pleas of York County, part of the Nineteenth Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Pennsylvania lemon law is 73 Pa. Stat. §1951 to §1960. If the manufacturer has a dispute program that follows federal FTC rules, the consumer must use it first, but its decision does not bind the consumer.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle, a full refund, or a cash settlement. Under the statute, a consumer who prevails can recover reasonable attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Your Rights Under Pennsylvania Law

What The Manufacturer Owes You

Pennsylvania's statute lists a replacement vehicle, a full refund, or a cash settlement. In practice, a qualifying York case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused.

Have Questions?

Frequently Asked Questions

The answers below are based on Pennsylvania law and on the paperwork York drivers usually send us.

PROCESS & TIMELINE
Most of the Pennsylvania cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Pennsylvania, the deadline under the statute is the first 12 months, 12,000 miles, or the express warranty period, whichever comes first.
Bring the repair orders from your York dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for York drivers settle with the manufacturer before a lawsuit is filed. In Pennsylvania, if the manufacturer has a dispute program that follows federal FTC rules, you must use it first, but its decision does not bind you. We prepare that filing for you.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Pennsylvania cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in 73 Pa. Stat. §1951 to §1960 requires you to appear anywhere to open a claim.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against 73 Pa. Stat. §1951 to §1960. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle, a full refund, or a cash settlement. Most cases settle at that stage. If a case does not settle, the next step is set by Pennsylvania law. In Pennsylvania, if the manufacturer has a dispute program that follows federal FTC rules, you must use it first, but its decision does not bind you.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”
