Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

How your Nebraska claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Nebraska claim gets built on two things: the Nebraska lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

York Lemon Law Basics
In York, as anywhere else in Nebraska, a lemon law claim is brought under Neb. Rev. Stat. §60-2701 to §60-2709. The statute covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use, limited to vehicles under 10,000 lbs GVWR, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Nebraska Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.
How a York Lemon Law Claim Works
This is what happens after you call us from York.
Document Your Repairs
Keep every repair order from your York dealership, even the short ones. Under Nebraska's lemon law, those papers are the written proof of each repair attempt.
Free Case Evaluation
We read your repair history against the Nebraska statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including the written notice to the manufacturer that Nebraska law requires. We deal with the manufacturer for you.
You Get Compensated
A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your York Car a Lemon? Nebraska's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Nebraska law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Nebraska the test is 4 repair attempts for the same defect or 40 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Nebraska, a claim must be brought within 1 year after the express warranty expires or within 2 years from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in York
York is in York County. York County's general civil trial court is the District Court of York County, in Nebraska Judicial District 5. Nebraska also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Nebraska lemon law is Neb. Rev. Stat. §60-2701 to §60-2709. If the manufacturer's arbitration program is certified, the consumer must complete it first.
The repair test in the statute is 4 repair attempts for the same defect, or 40 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Nebraska Motor Vehicle Industry Regulation - Lemon Law: The Rules That Decide a York Claim
The Nebraska repair test and arbitration rule are under Court and Venue above, so they are not repeated here. This section adds a few more rules from Nebraska law.
Notable provisions of Nebraska Motor Vehicle Industry Regulation - Lemon Law
The consumer must provide written notice to the manufacturer, and the manufacturer gets one final opportunity to repair. The law covers vehicles under 10,000 lbs GVWR.

What The Manufacturer Owes You
The Nebraska statute provides for a replacement vehicle or a full refund, minus a reasonable allowance for use, and a qualifying case from York usually ends in one of these three ways.
Refund
You hand back the car. In return the manufacturer repays the price, the taxes, the registration fees and the finance charges, with a reasonable use offset taken out.
Replacement Vehicle
You leave with a comparable new car. The manufacturer pays for the swap.
Cash Settlement
You keep the car, and the manufacturer pays you for the value the defect took off it. This result is not listed in the statute and comes from negotiation.
