Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders. We handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your Nebraska claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Nebraska claim gets built on two things: the Nebraska lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Omaha Lemon Law Basics
Nebraska's lemon law, Neb. Rev. Stat. §60-2701 to §60-2709, is the one that applies in Omaha. It covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use, limited to vehicles under 10,000 lbs GVWR. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Nebraska Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.
How an Omaha Lemon Law Claim Works
This is what happens after you call us from Omaha.
Document Your Repairs
Keep every repair order from your Omaha dealership, even the short ones. Under Nebraska's lemon law, those papers are the written proof of each repair attempt.
Free Case Evaluation
We read your repair history against the Nebraska statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including the written notice to the manufacturer that Nebraska law requires. We deal with the manufacturer for you.
You Get Compensated
A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your Omaha Car a Lemon? Nebraska's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Nebraska law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Nebraska the test is 4 repair attempts for the same defect or 40 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Nebraska, a claim must be brought within 1 year after the express warranty expires or within 2 years from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in Omaha
Omaha is in Douglas County. Douglas County's general civil trial court is the District Court of Douglas County, in Nebraska Judicial District 4. Nebraska also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Nebraska lemon law is Neb. Rev. Stat. §60-2701 to §60-2709. If the manufacturer's arbitration program is certified, the consumer must complete it first.
The repair test in the statute is 4 repair attempts for the same defect, or 40 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Looking for the repair test or the arbitration rule? Those are under Court and Venue above. Nebraska law has a few more rules, and they are listed here.
Notable provisions of Nebraska Motor Vehicle Industry Regulation - Lemon Law
The consumer must provide written notice to the manufacturer, and the manufacturer gets one final opportunity to repair. The law covers vehicles under 10,000 lbs GVWR.

What The Manufacturer Owes You
By statute, the Nebraska remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. When an Omaha car qualifies under Nebraska law, the case usually ends in one of three ways.
Refund
The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.
Replacement Vehicle
Instead of money you get a comparable new car, and the swap costs you nothing.
Cash Settlement
The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.
