How your Nebraska claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Nebraska claim gets built on two things: the Nebraska lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Crete Lemon Law

Crete Lemon Law Basics

The law that applies in Crete is Nebraska's lemon law, Neb. Rev. Stat. §60-2701 to §60-2709, and it covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use, limited to vehicles under 10,000 lbs GVWR. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Nebraska Lemon Law Attorneys page.

Step by Step

How a Crete Lemon Law Claim Works

This is what happens after you call us from Crete.

1

Document Your Repairs

Keep every repair order from your Crete dealership, even the short ones. Under Nebraska's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Nebraska statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Nebraska law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Neb. Rev. Stat. §60-2701 to §60-2709

Is Your Crete Car a Lemon? Nebraska's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Nebraska law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Nebraska the test is 4 repair attempts for the same defect or 40 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Nebraska, a claim must be brought within 1 year after the express warranty expires or within 2 years from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Saline County

Court and Venue in Crete

Crete is in Saline County. Saline County's general civil trial court is the District Court of Saline County, in Nebraska Judicial District 1. Nebraska also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Nebraska lemon law is Neb. Rev. Stat. §60-2701 to §60-2709. If the manufacturer's arbitration program is certified, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 40 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

The consumer must provide written notice to the manufacturer, and the manufacturer gets one final opportunity to repair. The law covers vehicles under 10,000 lbs GVWR.

Your Rights Under Nebraska Law

What The Manufacturer Owes You

By statute, the Nebraska remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. When a Crete car qualifies under Nebraska law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Nebraska law and on the paperwork Crete drivers usually send us.

PROCESS & TIMELINE
Most of the Nebraska cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Nebraska, a claim must be brought within 1 year after the express warranty expires or within 2 years from original delivery, whichever is earlier.
ELIGIBILITY
It may. Under Neb. Rev. Stat. §60-2701 to §60-2709, your Crete car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 40 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use. Nebraska's law covers vehicles under 10,000 lbs GVWR.
Neb. Rev. Stat. §60-2701 to §60-2709 covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use. Nebraska's law covers vehicles under 10,000 lbs GVWR. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
In Nebraska, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Neb. Rev. Stat. §60-2701 to §60-2709. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable allowance for use. Most cases settle at that stage. If a case does not settle, the next step is set by Nebraska law. In Nebraska, you must go through the manufacturer's arbitration program first if it is certified.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”
