How your Nebraska claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Nebraska claim gets built on two things: the Nebraska lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Gering Lemon Law

Gering Lemon Law Basics

In Gering, as anywhere else in Nebraska, a lemon law claim is brought under Neb. Rev. Stat. §60-2701 to §60-2709. The statute covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use, limited to vehicles under 10,000 lbs GVWR, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Nebraska Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Gering Lemon Law Claim Works

This is what happens after you call us from Gering.

1

Document Your Repairs

Keep every repair order from your Gering dealership, even the short ones. Under Nebraska's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Nebraska statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Nebraska law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Neb. Rev. Stat. §60-2701 to §60-2709

Is Your Gering Car a Lemon? Nebraska's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Nebraska law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Nebraska the test is 4 repair attempts for the same defect or 40 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Nebraska, a claim must be brought within 1 year after the express warranty expires or within 2 years from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Scotts Bluff County

Court and Venue in Gering

Gering is in Scotts Bluff County. Scotts Bluff County's general civil trial court is the District Court of Scotts Bluff County, in Nebraska Judicial District 12. Nebraska also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Nebraska lemon law is Neb. Rev. Stat. §60-2701 to §60-2709. If the manufacturer's arbitration program is certified, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 40 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Some Nebraska rules go beyond the repair test and the arbitration rule covered under Court and Venue above. Those other rules are here.

Notable provisions of Nebraska Motor Vehicle Industry Regulation - Lemon Law

The consumer must provide written notice to the manufacturer, and the manufacturer gets one final opportunity to repair. The law covers vehicles under 10,000 lbs GVWR.

Your Rights Under Nebraska Law

What The Manufacturer Owes You

Nebraska's statute lists a replacement vehicle or a full refund, minus a reasonable allowance for use. In practice, a qualifying Gering case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Nebraska law and on the paperwork Gering drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Gering dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under Neb. Rev. Stat. §60-2701 to §60-2709, your Gering car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 40 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use. Nebraska's law covers vehicles under 10,000 lbs GVWR.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
In Nebraska, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Nebraska, the manufacturer pays the consumer's attorney's fees when the consumer wins. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Neb. Rev. Stat. §60-2701 to §60-2709. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable allowance for use. Most cases settle at that stage. If a case does not settle, the next step is set by Nebraska law. In Nebraska, you must go through the manufacturer's arbitration program first if it is certified.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”
