How your Nebraska claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Nebraska claim gets built on two things: the Nebraska lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Hastings Lemon Law

Hastings Lemon Law Basics

A Hastings car is judged against Nebraska's statute, Neb. Rev. Stat. §60-2701 to §60-2709, and that law covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use, limited to vehicles under 10,000 lbs GVWR. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Nebraska Lemon Law Attorneys page.

Step by Step

How a Hastings Lemon Law Claim Works

This is what happens after you call us from Hastings.

1

Document Your Repairs

Keep every repair order from your Hastings dealership, even the short ones. Under Nebraska's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Nebraska statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Nebraska law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Neb. Rev. Stat. §60-2701 to §60-2709

Is Your Hastings Car a Lemon? Nebraska's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Nebraska law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Nebraska the test is 4 repair attempts for the same defect or 40 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Nebraska, a claim must be brought within 1 year after the express warranty expires or within 2 years from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Adams County

Court and Venue in Hastings

Hastings is in Adams County. Adams County's general civil trial court is the District Court of Adams County, in Nebraska Judicial District 10. Nebraska also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Nebraska lemon law is Neb. Rev. Stat. §60-2701 to §60-2709. If the manufacturer's arbitration program is certified, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 40 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Court and Venue above gives you the repair test and the arbitration rule. Nebraska law adds a few rules on top of those, and they follow.

Notable provisions of Nebraska Motor Vehicle Industry Regulation - Lemon Law

The consumer must provide written notice to the manufacturer, and the manufacturer gets one final opportunity to repair. The law covers vehicles under 10,000 lbs GVWR.

Your Rights Under Nebraska Law

What The Manufacturer Owes You

Nebraska's statute lists a replacement vehicle or a full refund, minus a reasonable allowance for use. In practice, a qualifying Hastings case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Frequently Asked Questions

The answers below are based on Nebraska law and on the paperwork Hastings drivers usually send us.

ELIGIBILITY
It may. Under Neb. Rev. Stat. §60-2701 to §60-2709, your Hastings car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 40 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use. Nebraska's law covers vehicles under 10,000 lbs GVWR.
Neb. Rev. Stat. §60-2701 to §60-2709 covers new motor vehicles purchased or leased in Nebraska for personal, family, or household use. Nebraska's law covers vehicles under 10,000 lbs GVWR. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
Under Neb. Rev. Stat. §60-2701 to §60-2709, the remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Which one you get depends on your repair history and on what the manufacturer offers.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Nebraska cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Neb. Rev. Stat. §60-2701 to §60-2709 requires you to appear anywhere to open a claim.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Neb. Rev. Stat. §60-2701 to §60-2709. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable allowance for use. Most cases settle at that stage. If a case does not settle, the next step is set by Nebraska law. In Nebraska, you must go through the manufacturer's arbitration program first if it is certified.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”
