How your Connecticut claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Connecticut claim gets built on two things: the Connecticut lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Westport Lemon Law

Westport Lemon Law Basics

A Westport car is judged against Connecticut's statute, Conn. Gen. Stat. §42-179, and that law covers new motor vehicles purchased or leased in Connecticut for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Connecticut Lemon Law Attorneys page.

Step by Step

How a Westport Lemon Law Claim Works

This is what happens after you call us from Westport.

1

Document Your Repairs

Keep every repair order from your Westport dealership, even the short ones. CT lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Connecticut statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that CT law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Conn. Gen. Stat. §42-179

Is Your Westport Car a Lemon? Connecticut's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Connecticut law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Connecticut the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

The Connecticut lemon law does not set its own deadline to sue, but defects must be reported within 2 years or 24,000 miles from original delivery, whichever is earlier. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Fairfield County

Court and Venue in Westport

Westport is in Fairfield County, but Connecticut assigns civil cases by town, not county. The Judicial Branch's town list places Westport in the Stamford/Norwalk Judicial District of the Connecticut Superior Court, the state's trial court for civil cases. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Connecticut lemon law is Conn. Gen. Stat. §42-179. The claim must go through the state-run arbitration program of the Department of Consumer Protection.

The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle, full refund, or monetary damages. The court may award a consumer who prevails costs and reasonable attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Connecticut Lemon Law: The Rules That Decide a Westport Claim

Beyond the repair test, the arbitration rule and the deadline, which are all in Court and Venue above, Connecticut law has some provisions of its own.

Notable provisions of Connecticut Lemon Law

Connecticut has a state-run arbitration program (not manufacturer-run). Only 2 repair attempts needed for defects that could cause death or serious injury. Also covers leased vehicles.

Your Rights Under CT Law

What The Manufacturer Owes You

Connecticut's statute lists replacement vehicle, full refund, or monetary damages. In practice, a qualifying Westport case under CT law usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused.

Have Questions?

Frequently Asked Questions

The answers below are based on Connecticut law and on the paperwork Westport drivers usually send us.

ELIGIBILITY
It may. Under Conn. Gen. Stat. §42-179, your Westport car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Connecticut for personal, family, or household use.
PROCESS & TIMELINE
Usually not. Most lemon law cases we handle for Westport drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Connecticut rule is: must use state-run arbitration program through the Department of Consumer Protection. We prepare that filing for you.
REMEDIES
Conn. Gen. Stat. §42-179 provides for replacement vehicle, full refund, or monetary damages. Which one you get depends on your repair history and on what the manufacturer offers.
In Connecticut, the court may award a consumer who prevails costs and reasonable attorney fees. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Connecticut cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Conn. Gen. Stat. §42-179 requires you to appear anywhere to open a claim. On arbitration, the Connecticut rule is: must use state-run arbitration program through the Department of Consumer Protection.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Conn. Gen. Stat. §42-179. Then written notice goes to the manufacturer, and we demand the statutory remedy, replacement vehicle, full refund, or monetary damages. Most cases settle at that stage. If a case does not settle, we take the next formal step that Connecticut law requires.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”
