How your Ohio claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Ohio claim gets built on two things: the Ohio lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Akron Lemon Law

Akron Lemon Law Basics

Ohio's lemon law, Ohio Rev. Code §1345.71 to §1345.77, is the one that applies in Akron. It covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Ohio Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How an Akron Lemon Law Claim Works

This is what happens after you call us from Akron.

1

Document Your Repairs

Keep every repair order from your Akron dealership, even the short ones. Under Ohio's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Ohio statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ohio Rev. Code §1345.71 to §1345.77

Is Your Akron Car a Lemon? Ohio's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Ohio law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Ohio cases:

  • ⚠️2025 Kia Sorento: Day-one no-start with check engine light
  • ⚠️2025 Kia Sorento: HPCU assembly failure
  • ⚠️2025 Kia Sorento: Fuel rail pressure sensor failure
  • ⚠️2025 Kia Sorento: Original main battery failure
2

Have You Met the Repair Attempt Threshold?

In Ohio the test is 3 repair attempts for the same defect (1 for serious safety defects), 8 or more attempts to repair any defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Summit County

Court and Venue in Akron

Akron is in Summit County. Summit County's general civil trial court is the Summit County Court of Common Pleas, General Division. Ohio also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Ohio lemon law is Ohio Rev. Code §1345.71 to §1345.77. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What the Statute Says

Ohio Lemon Law: The Rules That Decide an Akron Claim

Looking for the repair test or the arbitration rule? Those are under Court and Venue above. Ohio law has a few more rules, and they are listed here.

Notable provisions of Ohio Lemon Law

Ohio requires 3 repair attempts, or 1 where the nonconformity results in a condition likely to cause death or serious bodily injury if the vehicle is driven. Eight or more attempts to repair any nonconformity also raise the presumption. The law covers the first year/18,000 miles. The consumer must report the nonconformity within that period; the chapter prescribes no certified-mail and no final-repair-attempt requirement.

Your Rights Under Ohio Law

What The Manufacturer Owes You

By statute, the Ohio remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. When an Akron car qualifies under Ohio law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Ohio law and on the paperwork Akron drivers usually send us.

PROCESS & TIMELINE
Most of the Ohio cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier.
Bring the repair orders from your Akron dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
REMEDIES
Under Ohio Rev. Code §1345.71 to §1345.77, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Ohio cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ohio Rev. Code §1345.71 to §1345.77 requires you to appear anywhere to open a claim.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
