How your Ohio claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Ohio claim gets built on two things: the Ohio lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Youngstown Lemon Law

Youngstown Lemon Law Basics

Ohio's lemon law, Ohio Rev. Code §1345.71 to §1345.77, is the one that applies in Youngstown. It covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Ohio Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Youngstown Lemon Law Claim Works

This is what happens after you call us from Youngstown.

1

Document Your Repairs

Keep every repair order from your Youngstown dealership, even the short ones. Under Ohio's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Ohio statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ohio Rev. Code §1345.71 to §1345.77

Is Your Youngstown Car a Lemon? Ohio's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Ohio law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Ohio cases:

  • ⚠️2025 Kia Sorento: Day-one no-start with check engine light
  • ⚠️2025 Kia Sorento: HPCU assembly failure
  • ⚠️2025 Kia Sorento: Fuel rail pressure sensor failure
  • ⚠️2025 Kia Sorento: Original main battery failure
2

Have You Met the Repair Attempt Threshold?

In Ohio the test is 3 repair attempts for the same defect (1 for serious safety defects), 8 or more attempts to repair any defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Mahoning County & Trumbull County

Court and Venue in Youngstown

Parts of Youngstown lie in Mahoning County and Trumbull County, per the 2020 Census. Their general civil trial courts are the Mahoning County Court of Common Pleas, General Division and the Trumbull County Court of Common Pleas, General Division. Ohio also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Ohio lemon law is Ohio Rev. Code §1345.71 to §1345.77. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What the Statute Says

Ohio Lemon Law: The Rules That Decide a Youngstown Claim

Court and Venue above has the repair test and the arbitration rule for Ohio. The rules below are other points of Ohio law.

Notable provisions of Ohio Lemon Law

Ohio requires 3 repair attempts, or 1 where the nonconformity results in a condition likely to cause death or serious bodily injury if the vehicle is driven. Eight or more attempts to repair any nonconformity also raise the presumption. The law covers the first year/18,000 miles. The consumer must report the nonconformity within that period; the chapter prescribes no certified-mail and no final-repair-attempt requirement.

Your Rights Under Ohio Law

What The Manufacturer Owes You

What the manufacturer owes under Ohio's statute is a replacement vehicle or a full refund, minus a reasonable offset for use. Most qualifying cases from Youngstown end in one of the three results below.

$

Refund

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.

Replacement Vehicle

You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.

$

Cash Settlement

You keep driving the car and the manufacturer pays you for the lost value. This is a negotiated result, since the statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Ohio law and on the paperwork Youngstown drivers usually send us.

PROCESS & TIMELINE
Most of the Ohio cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier.
Bring the repair orders from your Youngstown dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Youngstown drivers settle with the manufacturer before a lawsuit is filed. In Ohio, you must use the manufacturer's arbitration program first if it is state-certified. We prepare that filing for you.
ELIGIBILITY
It may. Under Ohio Rev. Code §1345.71 to §1345.77, your Youngstown car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service. The statute covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use.
REMEDIES
In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Ohio Rev. Code §1345.71 to §1345.77. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Ohio law. In Ohio, you must use the manufacturer's arbitration program first if it is state-certified.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”
