How your Ohio claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Ohio claim gets built on two things: the Ohio lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Cuyahoga Falls Lemon Law

Cuyahoga Falls Lemon Law Basics

A Cuyahoga Falls car is judged against Ohio's statute, Ohio Rev. Code §1345.71 to §1345.77, and that law covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Ohio Lemon Law Attorneys page.

Step by Step

How a Cuyahoga Falls Lemon Law Claim Works

This is what happens after you call us from Cuyahoga Falls.

1

Document Your Repairs

Keep every repair order from your Cuyahoga Falls dealership, even the short ones. Under Ohio's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Ohio statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ohio Rev. Code §1345.71 to §1345.77

Is Your Cuyahoga Falls Car a Lemon? Ohio's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Ohio law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Ohio cases:

  • ⚠️2025 Kia Sorento: Day-one no-start with check engine light
  • ⚠️2025 Kia Sorento: HPCU assembly failure
  • ⚠️2025 Kia Sorento: Fuel rail pressure sensor failure
  • ⚠️2025 Kia Sorento: Original main battery failure
2

Have You Met the Repair Attempt Threshold?

In Ohio the test is 3 repair attempts for the same defect (1 for serious safety defects), 8 or more attempts to repair any defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Summit County

Court and Venue in Cuyahoga Falls

Cuyahoga Falls is in Summit County. Summit County's general civil trial court is the Summit County Court of Common Pleas, General Division. Ohio also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Ohio lemon law is Ohio Rev. Code §1345.71 to §1345.77. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What the Statute Says

Ohio Lemon Law: The Rules That Decide a Cuyahoga Falls Claim

The Ohio repair test and arbitration rule are under Court and Venue above, so they are not repeated here. This section adds a few more rules from Ohio law.

Notable provisions of Ohio Lemon Law

Ohio requires 3 repair attempts, or 1 where the nonconformity results in a condition likely to cause death or serious bodily injury if the vehicle is driven. Eight or more attempts to repair any nonconformity also raise the presumption. The law covers the first year/18,000 miles. The consumer must report the nonconformity within that period; the chapter prescribes no certified-mail and no final-repair-attempt requirement.

Your Rights Under Ohio Law

What The Manufacturer Owes You

Under Ohio law the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A qualifying case from Cuyahoga Falls usually closes in one of these three ways.

$

Refund

The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.

Replacement Vehicle

The manufacturer swaps your car for a comparable new one and pays for the exchange.

$

Cash Settlement

You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.

Have Questions?

Frequently Asked Questions

The answers below are based on Ohio law and on the paperwork Cuyahoga Falls drivers usually send us.

PROCESS & TIMELINE
Most of the Ohio cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier.
ELIGIBILITY
Ohio Rev. Code §1345.71 to §1345.77 covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
Under Ohio Rev. Code §1345.71 to §1345.77, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
