How your Ohio claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Ohio claim gets built on two things: the Ohio lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Lorain Lemon Law

Lorain Lemon Law Basics

The law that applies in Lorain is Ohio's lemon law, Ohio Rev. Code §1345.71 to §1345.77, and it covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Ohio Lemon Law Attorneys page.

Step by Step

How a Lorain Lemon Law Claim Works

This is what happens after you call us from Lorain.

1

Document Your Repairs

Keep every repair order from your Lorain dealership, even the short ones. Under Ohio's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Ohio statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ohio Rev. Code §1345.71 to §1345.77

Is Your Lorain Car a Lemon? Ohio's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Ohio law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Ohio cases:

  • ⚠️2025 Kia Sorento: Day-one no-start with check engine light
  • ⚠️2025 Kia Sorento: HPCU assembly failure
  • ⚠️2025 Kia Sorento: Fuel rail pressure sensor failure
  • ⚠️2025 Kia Sorento: Original main battery failure
2

Have You Met the Repair Attempt Threshold?

In Ohio the test is 3 repair attempts for the same defect (1 for serious safety defects), 8 or more attempts to repair any defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Lorain County

Court and Venue in Lorain

Lorain is in Lorain County. Lorain County's general civil trial court is the Lorain County Court of Common Pleas, General Division. Ohio also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Ohio lemon law is Ohio Rev. Code §1345.71 to §1345.77. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What the Statute Says

Ohio Lemon Law: The Rules That Decide a Lorain Claim

Court and Venue above has the repair test and the arbitration rule for Ohio. The rules below are other points of Ohio law.

Notable provisions of Ohio Lemon Law

Ohio requires 3 repair attempts, or 1 where the nonconformity results in a condition likely to cause death or serious bodily injury if the vehicle is driven. Eight or more attempts to repair any nonconformity also raise the presumption. The law covers the first year/18,000 miles. The consumer must report the nonconformity within that period; the chapter prescribes no certified-mail and no final-repair-attempt requirement.

Your Rights Under Ohio Law

What The Manufacturer Owes You

Under the statute, the remedy open to Ohio drivers is a replacement vehicle or a full refund, minus a reasonable offset for use. If your Lorain car qualifies, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Ohio law and on the paperwork Lorain drivers usually send us.

PROCESS & TIMELINE
Usually not. Most lemon law cases we handle for Lorain drivers settle with the manufacturer before a lawsuit is filed. In Ohio, you must use the manufacturer's arbitration program first if it is state-certified. We prepare that filing for you.
REMEDIES
Under Ohio Rev. Code §1345.71 to §1345.77, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Ohio cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ohio Rev. Code §1345.71 to §1345.77 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”
