How your Ohio claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Ohio claim gets built on two things: the Ohio lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Cincinnati Lemon Law

Cincinnati Lemon Law Basics

In Cincinnati, as anywhere else in Ohio, a lemon law claim is brought under Ohio Rev. Code §1345.71 to §1345.77. The statute covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Ohio Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Cincinnati Lemon Law Claim Works

This is what happens after you call us from Cincinnati.

1

Document Your Repairs

Keep every repair order from your Cincinnati dealership, even the short ones. Under Ohio's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Ohio statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ohio Rev. Code §1345.71 to §1345.77

Is Your Cincinnati Car a Lemon? Ohio's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Ohio law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Ohio cases:

  • ⚠️2025 Kia Sorento: Day-one no-start with check engine light
  • ⚠️2025 Kia Sorento: HPCU assembly failure
  • ⚠️2025 Kia Sorento: Fuel rail pressure sensor failure
  • ⚠️2025 Kia Sorento: Original main battery failure
2

Have You Met the Repair Attempt Threshold?

In Ohio the test is 3 repair attempts for the same defect (1 for serious safety defects), 8 or more attempts to repair any defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Hamilton County

Court and Venue in Cincinnati

Cincinnati is in Hamilton County. Hamilton County's general civil trial court is the Hamilton County Court of Common Pleas, General Division. Ohio also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Ohio lemon law is Ohio Rev. Code §1345.71 to §1345.77. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What the Statute Says

Ohio Lemon Law: The Rules That Decide a Cincinnati Claim

Some Ohio rules go beyond the repair test and the arbitration rule covered under Court and Venue above. Those other rules are here.

Notable provisions of Ohio Lemon Law

Ohio requires 3 repair attempts, or 1 where the nonconformity results in a condition likely to cause death or serious bodily injury if the vehicle is driven. Eight or more attempts to repair any nonconformity also raise the presumption. The law covers the first year/18,000 miles. The consumer must report the nonconformity within that period; the chapter prescribes no certified-mail and no final-repair-attempt requirement.

Your Rights Under Ohio Law

What The Manufacturer Owes You

Under Ohio law the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A qualifying case from Cincinnati usually closes in one of these three ways.

$

Refund

The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.

Replacement Vehicle

The manufacturer swaps your car for a comparable new one and pays for the exchange.

$

Cash Settlement

You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.

Have Questions?

Frequently Asked Questions

The answers below are based on Ohio law and on the paperwork Cincinnati drivers usually send us.

PROCESS & TIMELINE
Most of the Ohio cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Ohio, a claim must be brought within 5 years from original delivery, and defects must first be reported within 1 year or 18,000 miles, whichever is earlier.
ELIGIBILITY
It may. Under Ohio Rev. Code §1345.71 to §1345.77, your Cincinnati car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service. The statute covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use.
Ohio Rev. Code §1345.71 to §1345.77 covers new passenger cars and noncommercial motor vehicles purchased or leased in Ohio for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
In Ohio, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Ohio cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ohio Rev. Code §1345.71 to §1345.77 requires you to appear anywhere to open a claim.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”
