How your Illinois claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Illinois claim gets built on two things: the Illinois lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Waukegan Lemon Law

Waukegan Lemon Law Basics

Illinois's lemon law, 815 ILCS 380/1 to 380/7, is the one that applies in Waukegan. It covers new motor vehicles purchased or leased in Illinois for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Illinois Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Waukegan Lemon Law Claim Works

This is what happens after you call us from Waukegan.

1

Document Your Repairs

Keep every repair order from your Waukegan dealership, even the short ones. Under Illinois's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Illinois statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the direct written notice to the manufacturer that Illinois law requires before the presumption applies. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Waukegan Car a Lemon? Illinois's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Illinois law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in Easy Lemon's own Illinois cases:

  • ⚠️2023 Alfa Romeo Stelvio: Vehicle pulling / not tracking straight
  • ⚠️2025 Kia Telluride: Pulsing vibration in the accelerator above 45 mph
  • ⚠️2023 Alfa Romeo Stelvio: Key fob remote start and trunk unresponsive
  • ⚠️2025 Kia Telluride: Vibration worsens when turning
2

Have You Met the Repair Attempt Threshold?

In Illinois the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Illinois, a claim must be filed within 18 months from the date of original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Lake County

Court and Venue in Waukegan

Waukegan is in Lake County. Lake County's general civil trial court is the Circuit Court of the Nineteenth Judicial Circuit, Lake County. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Illinois lemon law is 815 ILCS 380/1 to 380/7. The statute's presumption that a car is a lemon does not apply unless the manufacturer received prior direct written notification and a chance to correct the defect (815 ILCS 380/3(h)); the statute names no delivery method. If the manufacturer's dispute program follows federal FTC rules and the consumer was told about it in writing, the consumer must use it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own.

Notable provisions of Illinois New Vehicle Buyer Protection Act

Illinois's coverage period is 1 year or 12,000 miles. Illinois counts business days for the out-of-service calculation, and the consumer must provide written notification to the manufacturer.

Your Rights Under Illinois Law

What The Manufacturer Owes You

Illinois's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying Waukegan case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Illinois law and on the paperwork Waukegan drivers usually send us.

PROCESS & TIMELINE
Most of the Illinois cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Illinois, a claim must be filed within 18 months from the date of original delivery.
Usually not. Most lemon law cases we handle for Waukegan drivers settle with the manufacturer before a lawsuit is filed. In Illinois, you must first use the manufacturer's dispute program if it follows federal FTC rules and you were told about it in writing. We prepare that filing for you.
ELIGIBILITY
815 ILCS 380/1 to 380/7 covers new motor vehicles purchased or leased in Illinois for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Illinois cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in 815 ILCS 380/1 to 380/7 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
