How your Illinois claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Illinois claim gets built on two things: the Illinois lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Chicago Lemon Law

Chicago Lemon Law Basics

The law that applies in Chicago is Illinois's lemon law, 815 ILCS 380/1 to 380/7, and it covers new motor vehicles purchased or leased in Illinois for personal, family, or household use. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Illinois Lemon Law Attorneys page.

Step by Step

How a Chicago Lemon Law Claim Works

This is what happens after you call us from Chicago.

1

Document Your Repairs

Keep every repair order from your Chicago dealership, even the short ones. IL lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Illinois statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that IL law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Chicago Car a Lemon? Illinois's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Illinois law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in Easy Lemon's own Illinois cases:

  • ⚠️2023 Alfa Romeo Stelvio: Vehicle pulling / not tracking straight
  • ⚠️2025 Kia Telluride: Persistent pulsing vibration on acceleration above 45 mph
  • ⚠️2023 Alfa Romeo Stelvio: Key fob remote start and trunk unresponsive
  • ⚠️2025 Kia Telluride: Vibration worsens when turning
2

Have You Met the Repair Attempt Threshold?

In Illinois the test is 4 repair attempts for the same defect, or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Illinois the deadline is 18 months from the date of original delivery. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Cook County & DuPage County

Court and Venue in Chicago

Parts of Chicago lie in Cook County and DuPage County, per the 2020 Census. Their general civil trial courts are the Circuit Court of Cook County and the Circuit Court of the Eighteenth Judicial Circuit, DuPage County. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Illinois lemon law is 815 ILCS 380/1 to 380/7. The presumption does not apply unless the manufacturer received prior direct written notification and a chance to correct the defect (815 ILCS 380/3(h)); the statute names no delivery method. If the manufacturer's dispute program follows federal FTC rules and the consumer was told about it in writing, the consumer must use it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own.

What the Statute Says

Illinois New Vehicle Buyer Protection Act: The Rules That Decide a Chicago Claim

Some Illinois rules sit outside the repair test, the arbitration rule and the deadline, which you can find under Court and Venue above. Those other rules are here.

Notable provisions of Illinois New Vehicle Buyer Protection Act

Illinois has a shorter coverage period (1 year/12,000 miles) than most states. Uses business days for out-of-service calculation. Consumer must provide written notification to manufacturer.

Your Rights Under IL Law

What The Manufacturer Owes You

By statute, the Illinois remedy is replacement vehicle or full refund (minus reasonable use offset). When a Chicago car qualifies under IL law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Illinois law and on the paperwork Chicago drivers usually send us.

PROCESS & TIMELINE
Most of the Illinois cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. The Illinois filing deadline is within 18 months from the date of original delivery.
Bring the repair orders from your Chicago dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under 815 ILCS 380/1 to 380/7, your Chicago car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Illinois for personal, family, or household use.
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. Illinois has a shorter coverage period (1 year/12,000 miles) than most states.
REMEDIES
The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) provides a fee-shifting route of its own when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Illinois cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in 815 ILCS 380/1 to 380/7 requires you to appear anywhere to open a claim. On arbitration, the Illinois rule is: must first use the manufacturer's dispute program if it follows federal FTC rules and you were told about it in writing.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”
