How your Illinois claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Illinois claim gets built on two things: the Illinois lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Skokie Lemon Law

Skokie Lemon Law Basics

Claims from Skokie fall under 815 ILCS 380/1 to 380/7, which covers new motor vehicles purchased or leased in Illinois for personal, family, or household use. If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Illinois Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How a Skokie Lemon Law Claim Works

This is what happens after you call us from Skokie.

1

Document Your Repairs

Keep every repair order from your Skokie dealership, even the short ones. Under Illinois's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Illinois statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the direct written notice to the manufacturer that Illinois law requires before the presumption applies. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Skokie Car a Lemon? Illinois's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Illinois law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in Easy Lemon's own Illinois cases:

  • ⚠️2023 Alfa Romeo Stelvio: Vehicle pulling / not tracking straight
  • ⚠️2025 Kia Telluride: Pulsing vibration in the accelerator above 45 mph
  • ⚠️2023 Alfa Romeo Stelvio: Key fob remote start and trunk unresponsive
  • ⚠️2025 Kia Telluride: Vibration worsens when turning
2

Have You Met the Repair Attempt Threshold?

In Illinois the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Illinois, a claim must be filed within 18 months from the date of original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Cook County

Court and Venue in Skokie

Skokie is in Cook County. Cook County's general civil trial court is the Circuit Court of Cook County. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Illinois lemon law is 815 ILCS 380/1 to 380/7. The statute's presumption that a car is a lemon does not apply unless the manufacturer received prior direct written notification and a chance to correct the defect (815 ILCS 380/3(h)); the statute names no delivery method. If the manufacturer's dispute program follows federal FTC rules and the consumer was told about it in writing, the consumer must use it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own.

What the Statute Says

Illinois New Vehicle Buyer Protection Act: The Rules That Decide a Skokie Claim

The Illinois repair test and arbitration rule are under Court and Venue above, so they are not repeated here. This section adds a few more rules from Illinois law.

Notable provisions of Illinois New Vehicle Buyer Protection Act

Illinois's coverage period is 1 year or 12,000 miles. Illinois counts business days for the out-of-service calculation, and the consumer must provide written notification to the manufacturer.

Your Rights Under Illinois Law

What The Manufacturer Owes You

By statute, the Illinois remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. When a Skokie car qualifies under Illinois law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Illinois law and on the paperwork Skokie drivers usually send us.

ELIGIBILITY
It may. Under 815 ILCS 380/1 to 380/7, your Skokie car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Illinois for personal, family, or household use.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) provides a fee-shifting route of its own when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Illinois cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in 815 ILCS 380/1 to 380/7 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. The Illinois lemon law (815 ILCS 380) has no attorney-fee provision of its own. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against 815 ILCS 380/1 to 380/7. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Illinois law. In Illinois, you must first use the manufacturer's dispute program if it follows federal FTC rules and you were told about it in writing.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”
