Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders. We handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

Your Kansas lemon law attorney
Admitted in Kansas
Nicole Forsythe handles Kansas lemon law claims as Of Counsel. She is admitted in Kansas and in Missouri, took her J.D. at the University of Missouri–Kansas City School of Law, and holds an LL.M. in Taxation. Kansas is unusual. Under Kan. Stat. §50-645 you can qualify on four repair attempts for one defect, or on ten repairs for any combination of them, and thirty cumulative days out of service counts too. The clock runs to the end of the warranty or one year from delivery, whichever lands first.

Topeka Lemon Law Basics
Kansas's lemon law, Kan. Stat. §50-645 to §50-646, is the one that applies in Topeka. It covers new motor vehicles purchased or leased in Kansas for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there. Kansas's lemon law sets no filing deadline of its own; defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. Our Kansas Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Does the Defect Substantially Impair Use, Value, or Safety?
Under Kansas law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Kansas the test is 4 repair attempts for the same defect, 10 total repairs for any combination of defects, or 30 cumulative calendar days out of service, within the period described in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
The Kansas lemon law does not set its own deadline to sue, but defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in Topeka
Topeka is in Shawnee County. Shawnee County's general civil trial court is the Shawnee County District Court, part of the Third Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Kansas lemon law is Kan. Stat. §50-645 to §50-646. If the manufacturer's arbitration program is certified and available, the consumer must use it.
The repair test in the statute is 4 repair attempts for the same defect (or 10 total for any combination of defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The Kansas lemon law has no attorney-fee provision of its own.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Kansas Consumer Protection Act - Lemon Law Provisions: The Rules That Decide a Topeka Claim
Court and Venue above gives you the repair test and the arbitration rule. Kansas law adds a few rules on top of those, and they follow.

Kansas also allows a "10 total repairs" trigger for any combination of defects.

What The Manufacturer Owes You
Kansas law provides for a replacement vehicle or a full refund, minus a reasonable offset for use. There are three ways a qualifying case from Topeka usually ends.
Refund
Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.
Replacement Vehicle
The manufacturer hands you a comparable new car and pays the cost of the exchange.
Cash Settlement
The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.
