Admitted in Kansas

Nicole Forsythe handles Kansas lemon law claims as Of Counsel. She is admitted in Kansas and in Missouri, took her J.D. at the University of Missouri–Kansas City School of Law, and holds an LL.M. in Taxation. Kansas is unusual. Under Kan. Stat. §50-645 you can qualify on four repair attempts for one defect, or on ten repairs for any combination of them, and thirty cumulative days out of service counts too. The clock runs to the end of the warranty or one year from delivery, whichever lands first.

Manhattan Lemon Law Basics

A Manhattan car is judged against Kansas's statute, Kan. Stat. §50-645 to §50-646, and that law covers new motor vehicles purchased or leased in Kansas for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do and the defect is still there, you may have a claim. Kansas's lemon law sets no filing deadline of its own; defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. The statute text, the filing deadlines and how used cars are treated are all on our Kansas Lemon Law Attorneys page.

Step by Step

How a Manhattan Lemon Law Claim Works

This is what happens after you call us from Manhattan.

1

Document Your Repairs

Keep every repair order from your Manhattan dealership, even the short ones. Under Kansas's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Kansas statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Kan. Stat. §50-645 to §50-646

Is Your Manhattan Car a Lemon? Kansas's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Kansas law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Kansas the test is 4 repair attempts for the same defect, 10 total repairs for any combination of defects, or 30 cumulative calendar days out of service, within the period described in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

The Kansas lemon law does not set its own deadline to sue, but defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

Pottawatomie County & Riley County

Court and Venue in Manhattan

Parts of Manhattan lie in Pottawatomie County and Riley County, per the 2020 Census. Their general civil trial courts are the Pottawatomie County District Court (2nd Judicial District) and the Riley County District Court (21st Judicial District). Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Kansas lemon law is Kan. Stat. §50-645 to §50-646. If the manufacturer's arbitration program is certified and available, the consumer must use it.

The repair test in the statute is 4 repair attempts for the same defect (or 10 total for any combination of defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The Kansas lemon law has no attorney-fee provision of its own.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Court and Venue above gives you the repair test and the arbitration rule. Kansas law adds a few rules on top of those, and they follow.

Kansas also allows a "10 total repairs" trigger for any combination of defects.

Your Rights Under Kansas Law

What The Manufacturer Owes You

Under the statute, the remedy open to Kansas drivers is a replacement vehicle or a full refund, minus a reasonable offset for use. If your Manhattan car qualifies, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Kansas law and on the paperwork Manhattan drivers usually send us.

PROCESS & TIMELINE
Most of the Kansas cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. Kansas's lemon law sets no filing deadline of its own; defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier.
ELIGIBILITY
It may. Under Kan. Stat. §50-645 to §50-646, your Manhattan car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect (or 10 total for any combination of defects), or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Kansas for personal, family, or household use.
Kan. Stat. §50-645 to §50-646 covers new motor vehicles purchased or leased in Kansas for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
The Kansas lemon law has no attorney-fee provision of its own. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) provides a fee-shifting route of its own when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Kan. Stat. §50-645 to §50-646. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Kansas law. In Kansas, you must use the manufacturer's arbitration program if it is certified and available.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”
