Admitted in Kansas

Nicole Forsythe handles Kansas lemon law claims as Of Counsel. She is admitted in Kansas and in Missouri, took her J.D. at the University of Missouri–Kansas City School of Law, and holds an LL.M. in Taxation. Kansas is unusual. Under Kan. Stat. §50-645 you can qualify on four repair attempts for one defect, or on ten repairs for any combination of them, and thirty cumulative days out of service counts too. The clock runs to the end of the warranty or one year from delivery, whichever lands first.

Wichita Lemon Law Basics

A Wichita car is judged against Kansas's statute, Kan. Stat. §50-645 to §50-646, and that law covers new motor vehicles purchased or leased in Kansas for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do and the defect is still there, you may have a claim. Kansas's lemon law sets no filing deadline of its own; defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. The statute text, the filing deadlines and how used cars are treated are all on our Kansas Lemon Law Attorneys page.

Step by Step

How a Wichita Lemon Law Claim Works

This is what happens after you call us from Wichita.

1

Document Your Repairs

Keep every repair order from your Wichita dealership, even the short ones. Under Kansas's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Kansas statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Wichita Car a Lemon? Kansas's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Kansas law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Kansas the test is 4 repair attempts for the same defect, 10 total repairs for any combination of defects, or 30 cumulative calendar days out of service, within the period described in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

The Kansas lemon law does not set its own deadline to sue, but defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Sedgwick County

Court and Venue in Wichita

Wichita is in Sedgwick County. Sedgwick County's general civil trial court is the 18th Judicial District Court, Sedgwick County. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Kansas lemon law is Kan. Stat. §50-645 to §50-646. If the manufacturer's arbitration program is certified and available, the consumer must use it.

The repair test in the statute is 4 repair attempts for the same defect (or 10 total for any combination of defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The Kansas lemon law has no attorney-fee provision of its own.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Kansas also allows a "10 total repairs" trigger for any combination of defects.

Your Rights Under Kansas Law

What The Manufacturer Owes You

Kansas's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying Wichita case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Kansas law and on the paperwork Wichita drivers usually send us.

PROCESS & TIMELINE
Most of the Kansas cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. Kansas's lemon law sets no filing deadline of its own; defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier.
Usually not. Most lemon law cases we handle for Wichita drivers settle with the manufacturer before a lawsuit is filed. In Kansas, you must use the manufacturer's arbitration program if it is certified and available. We prepare that filing for you.
ELIGIBILITY
It may. Under Kan. Stat. §50-645 to §50-646, your Wichita car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect (or 10 total for any combination of defects), or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Kansas for personal, family, or household use.
Kan. Stat. §50-645 to §50-646 covers new motor vehicles purchased or leased in Kansas for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
REMEDIES
Under Kan. Stat. §50-645 to §50-646, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Kansas cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Kan. Stat. §50-645 to §50-646 requires you to appear anywhere to open a claim.

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
