Under Florida law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in Easy Lemon's own Florida cases:

In Florida the test is 3 repair attempts for the same defect, plus a final repair attempt after written notice, or 30 cumulative calendar days (60 days for recreational vehicles) out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

Orange County

Court and Venue in Orlando

Orlando is in Orange County. Orange County's general civil trial court is the Circuit Court of the Ninth Judicial Circuit. Florida also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Florida lemon law is Fla. Stat. §681.10 to §681.118. Written notice to the manufacturer goes by registered or express mail, not certified mail (Fla. Stat. §681.104(1)(a)), and the manufacturer then gets a final repair attempt. The claim must first go through the Florida New Motor Vehicle Arbitration Board.

The repair test in the statute is 3 repair attempts for the same defect, plus a final repair attempt after written notice, or 30 cumulative calendar days (60 days for recreational vehicles) with the vehicle out of service. The statutory remedy is a replacement vehicle or a refund of the purchase price (minus a reasonable offset for use). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What The Manufacturer Owes You

Under the statute, the remedies open to Florida drivers are replacement vehicle or a refund of the purchase price (minus a reasonable offset for use). If your Orlando car qualifies under FL law, the case usually ends in one of the three ways below.

Bring the repair orders from your Orlando dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
REMEDIES
Fla. Stat. §681.10 to §681.118 provides for replacement vehicle or a refund of the purchase price (minus a reasonable offset for use). Which one you get depends on your repair history and on what the manufacturer offers.
In Florida, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ELIGIBILITY
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. Florida uses a state-run arbitration board (not manufacturer-run).
