Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders. We handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your Indiana claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Indiana claim gets built on two things: the Indiana lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

New Albany Lemon Law Basics
Indiana's lemon law, Ind. Code §24-5-13-1 to §24-5-13-24, is the one that applies in New Albany. It covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Indiana Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.
How a New Albany Lemon Law Claim Works
This is what happens after you call us from New Albany.
Document Your Repairs
Keep every repair order from your New Albany dealership, even the short ones. Under Indiana's lemon law, those papers are the written proof of each repair attempt.
Free Case Evaluation
We read your repair history against the Indiana statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including the written notice to the manufacturer that Indiana law requires when the manufacturer disclosed that requirement in the warranty or owner's manual. We deal with the manufacturer for you.
You Get Compensated
A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your New Albany Car a Lemon? Indiana's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Indiana law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Indiana the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in New Albany
New Albany is in Floyd County. Floyd County has both a Circuit Court and a Superior Court, and Indiana's judicial directory lists both for the county. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Indiana lemon law is Ind. Code §24-5-13-1 to §24-5-13-24. If the manufacturer's arbitration program is state-certified and available, the consumer must complete it first.
The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Indiana Motor Vehicle Protection Act: The Rules That Decide a New Albany Claim
We covered the repair test and the arbitration rule in the Court and Venue section above. Below are other Indiana rules that can matter to a New Albany claim.
Notable provisions of Indiana Motor Vehicle Protection Act
Indiana covers vehicles with a declared gross vehicle weight under 10,000 lbs, and its term of protection runs 18 months or 18,000 miles from delivery. Indiana counts business days for the out-of-service count. Written notice to the manufacturer is required where the manufacturer disclosed that requirement in the warranty or owner's manual.

What The Manufacturer Owes You
Indiana's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying New Albany case usually ends in one of three ways, and the cards below explain each.
Refund
You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.
Replacement Vehicle
You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.
Cash Settlement
The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.
