How your Indiana claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Indiana claim gets built on two things: the Indiana lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Elkhart Lemon Law

Elkhart Lemon Law Basics

In Elkhart, as anywhere else in Indiana, a lemon law claim is brought under Ind. Code §24-5-13-1 to §24-5-13-24. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Indiana Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How an Elkhart Lemon Law Claim Works

This is what happens after you call us from Elkhart.

1

Document Your Repairs

Keep every repair order from your Elkhart dealership, even the short ones. Under Indiana's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Indiana statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Indiana law requires when the manufacturer disclosed that requirement in the warranty or owner's manual. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Elkhart Car a Lemon? Indiana's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Indiana law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Indiana the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Elkhart County

Court and Venue in Elkhart

Elkhart is in Elkhart County. Elkhart County has both a Circuit Court and a Superior Court, and Indiana's judicial directory lists both for the county. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Indiana lemon law is Ind. Code §24-5-13-1 to §24-5-13-24. If the manufacturer's arbitration program is state-certified and available, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Indiana Motor Vehicle Protection Act: The Rules That Decide an Elkhart Claim

We covered the repair test and the arbitration rule in the Court and Venue section above. Below are other Indiana rules that can matter to an Elkhart claim.

Notable provisions of Indiana Motor Vehicle Protection Act

Indiana covers vehicles with a declared gross vehicle weight under 10,000 lbs, and its term of protection runs 18 months or 18,000 miles from delivery. Indiana counts business days for the out-of-service count. Written notice to the manufacturer is required where the manufacturer disclosed that requirement in the warranty or owner's manual.

Your Rights Under Indiana Law

What The Manufacturer Owes You

By statute, the Indiana remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. When an Elkhart car qualifies under Indiana law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Indiana law and on the paperwork Elkhart drivers usually send us.

ELIGIBILITY
It may. Under Ind. Code §24-5-13-1 to §24-5-13-24, your Elkhart car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
PROCESS & TIMELINE
Usually not. Most lemon law cases we handle for Elkhart drivers settle with the manufacturer before a lawsuit is filed. In Indiana, you must exhaust the manufacturer's arbitration program if it is state-certified and available. We prepare that filing for you.
REMEDIES
Under Ind. Code §24-5-13-1 to §24-5-13-24, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Indiana cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ind. Code §24-5-13-1 to §24-5-13-24 requires you to appear anywhere to open a claim.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Ind. Code §24-5-13-1 to §24-5-13-24. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Indiana law. In Indiana, you must exhaust the manufacturer's arbitration program if it is state-certified and available.
