How your Indiana claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Indiana claim gets built on two things: the Indiana lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Fort Wayne Lemon Law

Fort Wayne Lemon Law Basics

In Fort Wayne, as anywhere else in Indiana, a lemon law claim is brought under Ind. Code §24-5-13-1 to §24-5-13-24. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Indiana Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Fort Wayne Lemon Law Claim Works

This is what happens after you call us from Fort Wayne.

1

Document Your Repairs

Keep every repair order from your Fort Wayne dealership, even the short ones. Under Indiana's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Indiana statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Indiana law requires when the manufacturer disclosed that requirement in the warranty or owner's manual. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Fort Wayne Car a Lemon? Indiana's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Indiana law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Indiana the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Allen County

Court and Venue in Fort Wayne

Fort Wayne is in Allen County. Allen County has both a Circuit Court and a Superior Court, and Indiana's judicial directory lists both for the county. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Indiana lemon law is Ind. Code §24-5-13-1 to §24-5-13-24. If the manufacturer's arbitration program is state-certified and available, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Indiana Motor Vehicle Protection Act: The Rules That Decide a Fort Wayne Claim

Looking for the repair test or the arbitration rule? Those are under Court and Venue above. Indiana law has a few more rules, and they are listed here.

Notable provisions of Indiana Motor Vehicle Protection Act

Indiana covers vehicles with a declared gross vehicle weight under 10,000 lbs, and its term of protection runs 18 months or 18,000 miles from delivery. Indiana counts business days for the out-of-service count. Written notice to the manufacturer is required where the manufacturer disclosed that requirement in the warranty or owner's manual.

Your Rights Under Indiana Law

What The Manufacturer Owes You

Under Indiana law the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A qualifying case from Fort Wayne usually closes in one of these three ways.

$

Refund

The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.

Replacement Vehicle

The manufacturer swaps your car for a comparable new one and pays for the exchange.

$

Cash Settlement

You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.

Have Questions?

Frequently Asked Questions

The answers below are based on Indiana law and on the paperwork Fort Wayne drivers usually send us.

PROCESS & TIMELINE
Most of the Indiana cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer.
Usually not. Most lemon law cases we handle for Fort Wayne drivers settle with the manufacturer before a lawsuit is filed. In Indiana, you must exhaust the manufacturer's arbitration program if it is state-certified and available. We prepare that filing for you.
ELIGIBILITY
It may. Under Ind. Code §24-5-13-1 to §24-5-13-24, your Fort Wayne car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes.
REMEDIES
Under Ind. Code §24-5-13-1 to §24-5-13-24, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Indiana, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Indiana, a consumer who wins may recover attorney's fees from the manufacturer. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”
