How your Indiana claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Indiana claim gets built on two things: the Indiana lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Lafayette Lemon Law

Lafayette Lemon Law Basics

In Lafayette, as anywhere else in Indiana, a lemon law claim is brought under Ind. Code §24-5-13-1 to §24-5-13-24. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Indiana Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Lafayette Lemon Law Claim Works

This is what happens after you call us from Lafayette.

1

Document Your Repairs

Keep every repair order from your Lafayette dealership, even the short ones. Under Indiana's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Indiana statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Indiana law requires when the manufacturer disclosed that requirement in the warranty or owner's manual. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ind. Code §24-5-13-1 to §24-5-13-24

Is Your Lafayette Car a Lemon? Indiana's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Indiana law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Indiana the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

Tippecanoe County

Court and Venue in Lafayette

Lafayette is in Tippecanoe County. Tippecanoe County has both a Circuit Court and a Superior Court, and Indiana's judicial directory lists both for the county. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Indiana lemon law is Ind. Code §24-5-13-1 to §24-5-13-24. If the manufacturer's arbitration program is state-certified and available, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Indiana Motor Vehicle Protection Act: The Rules That Decide a Lafayette Claim

Looking for the repair test or the arbitration rule? Those are under Court and Venue above. Indiana law has a few more rules, and they are listed here.

Notable provisions of Indiana Motor Vehicle Protection Act

Indiana covers vehicles with a declared gross vehicle weight under 10,000 lbs, and its term of protection runs 18 months or 18,000 miles from delivery. Indiana counts business days for the out-of-service count. Written notice to the manufacturer is required where the manufacturer disclosed that requirement in the warranty or owner's manual.

Your Rights Under Indiana Law

What The Manufacturer Owes You

Indiana's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying Lafayette case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Indiana law and on the paperwork Lafayette drivers usually send us.

PROCESS & TIMELINE
Most of the Indiana cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer.
Bring the repair orders from your Lafayette dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under Ind. Code §24-5-13-1 to §24-5-13-24, your Lafayette car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Indiana cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ind. Code §24-5-13-1 to §24-5-13-24 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. In Indiana, a consumer who wins may recover attorney's fees from the manufacturer. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
