How your Indiana claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Indiana claim gets built on two things: the Indiana lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Indianapolis Lemon Law Basics

Indiana's lemon law, Ind. Code §24-5-13-1 to §24-5-13-24, is the one that applies in Indianapolis. It covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Indiana Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How an Indianapolis Lemon Law Claim Works

This is what happens after you call us from Indianapolis.

1

Document Your Repairs

Keep every repair order from your Indianapolis dealership, even the short ones. Under Indiana's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Indiana statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Indiana law requires when the manufacturer disclosed that requirement in the warranty or owner's manual. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ind. Code §24-5-13-1 to §24-5-13-24

Is Your Indianapolis Car a Lemon? Indiana's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Indiana law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Indiana the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Indiana, a claim must be filed within 2 years after the buyer first reports the defect to the manufacturer, its agent, or an authorized dealer. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Marion County

Court and Venue in Indianapolis

Indianapolis is in Marion County. Marion County has both a Circuit Court and a Superior Court, and Indiana's judicial directory lists both for the county. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Indiana lemon law is Ind. Code §24-5-13-1 to §24-5-13-24. If the manufacturer's arbitration program is state-certified and available, the consumer must complete it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Indiana Motor Vehicle Protection Act: The Rules That Decide an Indianapolis Claim

Indiana law sets a repair test and says whether arbitration comes first, and Court and Venue above already explains both. Here are a few of its other rules.

Notable provisions of Indiana Motor Vehicle Protection Act

Indiana covers vehicles with a declared gross vehicle weight under 10,000 lbs, and its term of protection runs 18 months or 18,000 miles from delivery. Indiana counts business days for the out-of-service count. Written notice to the manufacturer is required where the manufacturer disclosed that requirement in the warranty or owner's manual.

Your Rights Under Indiana Law

What The Manufacturer Owes You

By statute, the Indiana remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. When an Indianapolis car qualifies under Indiana law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Indiana law and on the paperwork Indianapolis drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Indianapolis dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under Ind. Code §24-5-13-1 to §24-5-13-24, your Indianapolis car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Indiana and used primarily for personal, family, or household purposes.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
Under Ind. Code §24-5-13-1 to §24-5-13-24, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Indiana, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Indiana cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ind. Code §24-5-13-1 to §24-5-13-24 requires you to appear anywhere to open a claim.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”
