Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders, and we handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your New Mexico claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A New Mexico claim gets built on two things: the New Mexico lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Clovis Lemon Law Basics
A Clovis car is judged against New Mexico's statute, N.M. Stat. §57-16A-1 to §57-16A-9, and that law covers new motor vehicles purchased or leased in New Mexico for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our New Mexico Lemon Law Attorneys page.
How a Clovis Lemon Law Claim Works
This is what happens after you call us from Clovis.
Document Your Repairs
Keep every repair order from your Clovis dealership, even the short ones. NM lemon law needs written proof of each repair attempt, and those papers are the proof.
Free Case Evaluation
We read your repair history against the New Mexico statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including any written notice to the manufacturer that NM law requires. We deal with the manufacturer for you.
You Get Compensated
The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your Clovis Car a Lemon? New Mexico's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under New Mexico law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In New Mexico the test is 4 repair attempts for the same defect, or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In New Mexico the deadline is 18 months following the date of original delivery, or 90 days after the final action of an informal dispute settlement panel, whichever is later. We check it against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in Clovis
Clovis is in Curry County. Curry County's general civil trial court is the Ninth Judicial District Court. New Mexico also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The New Mexico lemon law is N.M. Stat. §57-16A-1 to §57-16A-9. If the manufacturer's arbitration program is state-certified, the consumer must complete it first.
The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails may recover attorney fees.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

New Mexico Motor Vehicle Quality Assurance Act: The Rules That Decide a Clovis Claim
If you have read Court and Venue above, you already have the repair test, the arbitration rule and the deadline. New Mexico law adds a few rules on top of those, and they follow.
Notable provisions of New Mexico Motor Vehicle Quality Assurance Act
New Mexico requires 4 repair attempts and counts business days. The consumer must give prior direct written notice to the manufacturer and an opportunity to cure. Covers vehicles with a gross vehicle weight under 10,000 lbs.

What The Manufacturer Owes You
New Mexico's statute lists replacement vehicle or full refund (minus reasonable use offset). In practice, a qualifying Clovis case under NM law usually ends in one of three ways, and the cards below explain each.
Refund
You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.
Replacement Vehicle
You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.
Cash Settlement
The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.
