Gallup Lemon Law Basics
New Mexico's lemon law, N.M. Stat. §57-16A-1 to §57-16A-9, is the one that applies in Gallup. It covers new motor vehicles purchased or leased in New Mexico for personal, family, or household use, and you may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Under New Mexico law, the defect has to substantially impair the vehicle's use, value, or safety.

Court and Venue in Gallup
Gallup is in McKinley County. McKinley County's general civil trial court is the Eleventh Judicial District Court. New Mexico also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The New Mexico lemon law is N.M. Stat. §57-16A-1 to §57-16A-9. If the manufacturer's arbitration program is state-certified, the consumer must complete it first.
The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails may recover attorney fees.

What The Manufacturer Owes You
