Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders, and we handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your Delaware claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Delaware claim gets built on two things: the Delaware lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Clayton Lemon Law Basics
A Clayton car is judged against Delaware's statute, Del. Code tit. 6, §5001 to §5009, and that law covers new motor vehicles purchased or leased in Delaware for personal, family, or household use (under 10,000 lbs GVWR). So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Delaware Lemon Law Attorneys page.
How a Clayton Lemon Law Claim Works
This is what happens after you call us from Clayton.
Document Your Repairs
Keep every repair order from your Clayton dealership, even the short ones. DE lemon law needs written proof of each repair attempt, and those papers are the proof.
Free Case Evaluation
We read your repair history against the Delaware statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including any written notice to the manufacturer that DE law requires. We deal with the manufacturer for you.
You Get Compensated
The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your Clayton Car a Lemon? Delaware's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Delaware law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Delaware the test is 4 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
The Delaware lemon law does not set its own deadline to sue, but defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. We check it against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in Clayton
Parts of Clayton lie in Kent County and New Castle County, per the 2020 Census. Their general civil trial courts are the Superior Court of the State of Delaware, sitting in Kent County and the Superior Court of the State of Delaware, sitting in New Castle County. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Delaware lemon law is Del. Code tit. 6, §5001 to §5009. Arbitration is available in Delaware but not required before a lawsuit.
The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). The court may award a consumer who prevails costs and reasonable attorney fees.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Delaware Lemon Law: The Rules That Decide a Clayton Claim
Some Delaware rules sit outside the repair test, the arbitration rule and the deadline, which you can find under Court and Venue above. Those other rules are here.
Notable provisions of Delaware Lemon Law
Delaware requires the manufacturer to provide a clear written warranty at time of sale. The lemon law specifically covers motor homes (the chassis and drivetrain, not the living quarters).

What The Manufacturer Owes You
Delaware's statute lists replacement vehicle or full refund (minus reasonable use offset). In practice, a qualifying Clayton case under DE law usually ends in one of three ways, and the cards below explain each.
Refund
You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.
Replacement Vehicle
You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.
Cash Settlement
The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.
