What the Georgia Motor Vehicle Warranty Rights Act Covers
Georgia's lemon law (O.C.G.A. §10-1-780 et seq.) gives consumers a legal right to a replacement vehicle or a refund when a new vehicle has a defect the manufacturer cannot repair after a reasonable number of attempts. The defect must substantially impair the vehicle's use, value, or safety.
The law generally applies during the manufacturer's express warranty period. A "reasonable number of attempts" is typically defined as three or more repair attempts for the same defect, or 30 cumulative days out of service. Once those thresholds are met, the owner may send formal written notice to the manufacturer demanding a final repair opportunity — and if that fails, the manufacturer is required to repurchase or replace the vehicle.
