How your Delaware claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Delaware claim gets built on two things: the Delaware lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Millsboro Lemon Law

Millsboro Lemon Law Basics

Claims from Millsboro fall under Del. Code tit. 6, §5001 to §5009, which covers new motor vehicles purchased or leased in Delaware for personal, family, or household use (under 10,000 lbs GVWR). If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Delaware Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How a Millsboro Lemon Law Claim Works

This is what happens after you call us from Millsboro.

1

Document Your Repairs

Keep every repair order from your Millsboro dealership, even the short ones. DE lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Delaware statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that DE law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Del. Code tit. 6, §5001 to §5009

Is Your Millsboro Car a Lemon? Delaware's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Delaware law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Delaware the test is 4 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

The Delaware lemon law does not set its own deadline to sue, but defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Sussex County

Court and Venue in Millsboro

Millsboro is in Sussex County. Sussex County's general civil trial court is the Superior Court of the State of Delaware, sitting in Sussex County. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Delaware lemon law is Del. Code tit. 6, §5001 to §5009. Arbitration is available in Delaware but not required before a lawsuit.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). The court may award a consumer who prevails costs and reasonable attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Delaware Lemon Law: The Rules That Decide a Millsboro Claim

If you have read Court and Venue above, you already have the repair test, the arbitration rule and the deadline. Delaware law adds a few rules on top of those, and they follow.

Notable provisions of Delaware Lemon Law

Delaware requires the manufacturer to provide a clear written warranty at time of sale. The lemon law specifically covers motor homes (the chassis and drivetrain, not the living quarters).

Your Rights Under DE Law

What The Manufacturer Owes You

Under the statute, the remedies open to Delaware drivers are replacement vehicle or full refund (minus reasonable use offset). If your Millsboro car qualifies under DE law, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Delaware law and on the paperwork Millsboro drivers usually send us.

PROCESS & TIMELINE
Most of the Delaware cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. The Delaware lemon law does not set its own filing deadline, but defects must be reported within the warranty term or 1 year from original delivery, whichever is earlier.
Bring the repair orders from your Millsboro dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
REMEDIES
Del. Code tit. 6, §5001 to §5009 provides for replacement vehicle or full refund (minus reasonable use offset). Which one you get depends on your repair history and on what the manufacturer offers.
In Delaware, the court may award a consumer who prevails costs and reasonable attorney fees. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ELIGIBILITY
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. Delaware requires the manufacturer to provide a clear written warranty at time of sale.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Delaware cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Del. Code tit. 6, §5001 to §5009 requires you to appear anywhere to open a claim. On arbitration, the Delaware rule is: arbitration is available but not required before litigation.
