How your West Virginia claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A West Virginia claim gets built on two things: the West Virginia lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Charles Town Lemon Law

Charles Town Lemon Law Basics

West Virginia's lemon law, W. Va. Code §46A-6A-1 to §46A-6A-9, is the one that applies in Charles Town. It covers new motor vehicles purchased or leased in West Virginia for personal, family, or household use, and you may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our West Virginia Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Charles Town Lemon Law Claim Works

This is what happens after you call us from Charles Town.

1

Document Your Repairs

Keep every repair order from your Charles Town dealership, even the short ones. WV lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the West Virginia statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that WV law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

W. Va. Code §46A-6A-1 to §46A-6A-9

Is Your Charles Town Car a Lemon? West Virginia's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under West Virginia law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In West Virginia the test is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In West Virginia the deadline is 1 year of the expiration of the express warranty term. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Jefferson County

Court and Venue in Charles Town

Charles Town is in Jefferson County. Jefferson County's general civil trial court is the Circuit Court of Jefferson County, part of the Twenty-Eighth Judicial Circuit. West Virginia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The West Virginia lemon law is W. Va. Code §46A-6A-1 to §46A-6A-9. If the manufacturer's arbitration program is state-certified, the consumer must complete it first.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

West Virginia Lemon Law - Motor Vehicle Warranties Act: The Rules That Decide a Charles Town Claim

We covered the repair test, the arbitration rule and the deadline in the Court and Venue section above. Below are other West Virginia rules that can matter to a Charles Town claim.

Notable provisions of West Virginia Lemon Law - Motor Vehicle Warranties Act

West Virginia requires 3 repair attempts, and only 1 when the nonconformity is likely to cause death or serious bodily injury if the vehicle is driven. Prior written notification to the manufacturer and at least one opportunity to cure are required.

Your Rights Under WV Law

What The Manufacturer Owes You

What the manufacturer owes under West Virginia's statute is replacement vehicle or full refund (minus reasonable use offset). Most qualifying cases from Charles Town under WV law end in one of the three results below.

$

Refund

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.

Replacement Vehicle

You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.

$

Cash Settlement

You keep driving the car and the manufacturer pays you for the lost value. This is a negotiated result, since the statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on West Virginia law and on the paperwork Charles Town drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Charles Town dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under W. Va. Code §46A-6A-1 to §46A-6A-9, your Charles Town car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in West Virginia for personal, family, or household use.
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. West Virginia requires 3 repair attempts, and only 1 when the nonconformity is likely to cause death or serious bodily injury if the vehicle is driven.
REMEDIES
W. Va. Code §46A-6A-1 to §46A-6A-9 provides for replacement vehicle or full refund (minus reasonable use offset). Which one you get depends on your repair history and on what the manufacturer offers.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In West Virginia, a consumer who wins may recover attorney's fees from the manufacturer. In most successful West Virginia claims, the manufacturer pays our fee. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against W. Va. Code §46A-6A-1 to §46A-6A-9. Then written notice goes to the manufacturer, and we demand the statutory remedy, replacement vehicle or full refund (minus reasonable use offset). Most cases settle at that stage. If a case does not settle, we take the next formal step that West Virginia law requires.

“My Dodge Challenger's AC would blow hot air on the driver side but cold on passenger. Dealer recharged it twice, replaced a blend door actuator once. Problem came back every time. I was sweating through my shirt in August. Called Easy Lemon and Aaron Waldo said a climate control issue that makes driving uncomfortable counts. His team fought Dodge and got me a cash settlement. Got it fixed at a local shop and the AC has been cold ever since.”

“I had a good experience with Easy lemon. I had bought a used truck that had transmission issues before I even got it home. After a year of the dealership giving me the runaround, I reached out to Easy Lemon. It was a drawn out process dealing with the vehicle manufacturer. We got it done and I am happy with the results. Thanks to Vanessa, Antonio, Fabio, and the rest of the team that made this possible.”
