How your West Virginia claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A West Virginia claim gets built on two things: the West Virginia lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Bridgeport Lemon Law

Bridgeport Lemon Law Basics

In Bridgeport, as anywhere else in West Virginia, a lemon law claim is brought under W. Va. Code §46A-6A-1 to §46A-6A-9. The statute covers new motor vehicles purchased or leased in West Virginia for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our West Virginia Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Bridgeport Lemon Law Claim Works

This is what happens after you call us from Bridgeport.

1

Document Your Repairs

Keep every repair order from your Bridgeport dealership, even the short ones. WV lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the West Virginia statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that WV law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

W. Va. Code §46A-6A-1 to §46A-6A-9

Is Your Bridgeport Car a Lemon? West Virginia's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under West Virginia law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In West Virginia the test is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In West Virginia the deadline is 1 year of the expiration of the express warranty term. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Harrison County

Court and Venue in Bridgeport

Bridgeport is in Harrison County. Harrison County's general civil trial court is the Circuit Court of Harrison County, part of the Nineteenth Judicial Circuit. West Virginia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The West Virginia lemon law is W. Va. Code §46A-6A-1 to §46A-6A-9. If the manufacturer's arbitration program is state-certified, the consumer must complete it first.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

West Virginia Lemon Law - Motor Vehicle Warranties Act: The Rules That Decide a Bridgeport Claim

Looking for the repair test, the deadline or the arbitration rule? Those are under Court and Venue above. West Virginia law has a few more rules, and they are listed here.

Notable provisions of West Virginia Lemon Law - Motor Vehicle Warranties Act

West Virginia requires 3 repair attempts, and only 1 when the nonconformity is likely to cause death or serious bodily injury if the vehicle is driven. Prior written notification to the manufacturer and at least one opportunity to cure are required.

Your Rights Under WV Law

What The Manufacturer Owes You

Under the statute, the remedies open to West Virginia drivers are replacement vehicle or full refund (minus reasonable use offset). If your Bridgeport car qualifies under WV law, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on West Virginia law and on the paperwork Bridgeport drivers usually send us.

PROCESS & TIMELINE
Usually not. Most lemon law cases we handle for Bridgeport drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the West Virginia rule is: must exhaust manufacturer's arbitration if state-certified. We prepare that filing for you.
ELIGIBILITY
W. Va. Code §46A-6A-1 to §46A-6A-9 covers new motor vehicles purchased or leased in West Virginia for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
REMEDIES
W. Va. Code §46A-6A-1 to §46A-6A-9 provides for replacement vehicle or full refund (minus reasonable use offset). Which one you get depends on your repair history and on what the manufacturer offers.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle West Virginia cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in W. Va. Code §46A-6A-1 to §46A-6A-9 requires you to appear anywhere to open a claim. On arbitration, the West Virginia rule is: must exhaust manufacturer's arbitration if state-certified.
Nothing upfront, and no attorney's fee unless we recover for you. In West Virginia, a consumer who wins may recover attorney's fees from the manufacturer. In most successful West Virginia claims, the manufacturer pays our fee. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against W. Va. Code §46A-6A-1 to §46A-6A-9. Then written notice goes to the manufacturer, and we demand the statutory remedy, replacement vehicle or full refund (minus reasonable use offset). Most cases settle at that stage. If a case does not settle, we take the next formal step that West Virginia law requires.
