Huntington Lemon Law Basics
In Huntington, as anywhere else in West Virginia, a lemon law claim is brought under W. Va. Code §46A-6A-1 to §46A-6A-9. The statute covers new motor vehicles purchased or leased in West Virginia for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Under West Virginia law, the defect has to substantially impair the vehicle's use, value, or safety.

In West Virginia the test is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Court and Venue in Huntington
Parts of Huntington lie in Cabell County and Wayne County, per the 2020 Census. Their general civil trial courts are the Circuit Court of Cabell County (Sixth Judicial Circuit) and the Circuit Court of Wayne County (Tenth Judicial Circuit). West Virginia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The West Virginia lemon law is W. Va. Code §46A-6A-1 to §46A-6A-9. If the manufacturer's arbitration program is state-certified, the consumer must complete it first.
The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails may recover attorney fees.
