How your Georgia claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Georgia claim gets built on two things: the Georgia lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Savannah Lemon Law

Savannah Lemon Law Basics

A Savannah car is judged against Georgia's statute, Ga. Code §10-1-780 to §10-1-795, and that law covers new motor vehicles purchased or leased in Georgia for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Georgia Lemon Law Attorneys page.

Step by Step

How a Savannah Lemon Law Claim Works

This is what happens after you call us from Savannah.

1

Document Your Repairs

Keep every repair order from your Savannah dealership, even the short ones. Under Georgia's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Georgia statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the notice to the manufacturer by statutory overnight delivery or certified mail, return receipt requested, that Georgia law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ga. Code §10-1-780 to §10-1-795

Is Your Savannah Car a Lemon? Georgia's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Georgia law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Georgia the test is 3 repair attempts for the same defect (1 for serious safety defects) or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Georgia, you must apply for state arbitration within 1 year after the lemon law rights period ends, or within 60 days after a certified manufacturer program's decision if that is later. The rights period is 2 years or 24,000 miles from delivery, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Chatham County

Court and Venue in Savannah

Savannah is in Chatham County. Chatham County's general civil trial court is the Superior Court of Chatham County, part of the Eastern Judicial Circuit. Georgia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Georgia lemon law is Ga. Code §10-1-780 to §10-1-795. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The state arbitration panel may award attorney fees to a consumer who prevails. If the manufacturer appeals and the consumer prevails in court, the recovery includes attorney fees and court costs.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Georgia Lemon Law: The Rules That Decide a Savannah Claim

We covered the repair test and the arbitration rule in the Court and Venue section above. Below are other Georgia rules that can matter to a Savannah claim.

Notable provisions of Georgia Lemon Law

Georgia requires the consumer to notify the manufacturer by statutory overnight delivery or certified mail, return receipt requested, once a reasonable number of repair attempts has been reached. The manufacturer then has 28 days to make a final attempt to repair. One repair attempt is sufficient for a serious safety defect. Trucks over 12,000 lbs gross vehicle weight rating, motorcycles, and golf carts are excluded.

Your Rights Under Georgia Law

What The Manufacturer Owes You

What the manufacturer owes under Georgia's statute is a replacement vehicle or a full refund, minus a reasonable offset for use. Most qualifying cases from Savannah end in one of the three results below.

$

Refund

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.

Replacement Vehicle

You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.

$

Cash Settlement

You keep driving the car and the manufacturer pays you for the lost value. This is a negotiated result, since the statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Georgia law and on the paperwork Savannah drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Savannah dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under Ga. Code §10-1-780 to §10-1-795, your Savannah car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Georgia for personal, family, or household use.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
In Georgia, the state arbitration panel may award attorney fees to a consumer who prevails. If the manufacturer appeals and the consumer prevails in court, the recovery includes attorney fees and court costs. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Georgia cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ga. Code §10-1-780 to §10-1-795 requires you to appear anywhere to open a claim.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
