How your Georgia claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Georgia claim gets built on two things: the Georgia lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Valdosta Lemon Law

Valdosta Lemon Law Basics

In Valdosta, as anywhere else in Georgia, a lemon law claim is brought under Ga. Code §10-1-780 to §10-1-795. The statute covers new motor vehicles purchased or leased in Georgia for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Georgia Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Valdosta Lemon Law Claim Works

This is what happens after you call us from Valdosta.

1

Document Your Repairs

Keep every repair order from your Valdosta dealership, even the short ones. Under Georgia's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Georgia statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the notice to the manufacturer by statutory overnight delivery or certified mail, return receipt requested, that Georgia law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ga. Code §10-1-780 to §10-1-795

Is Your Valdosta Car a Lemon? Georgia's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Georgia law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Georgia the test is 3 repair attempts for the same defect (1 for serious safety defects) or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Georgia, you must apply for state arbitration within 1 year after the lemon law rights period ends, or within 60 days after a certified manufacturer program's decision if that is later. The rights period is 2 years or 24,000 miles from delivery, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Lowndes County

Court and Venue in Valdosta

Valdosta is in Lowndes County. Lowndes County's general civil trial court is the Superior Court of Lowndes County, part of the Southern Judicial Circuit. Georgia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Georgia lemon law is Ga. Code §10-1-780 to §10-1-795. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The state arbitration panel may award attorney fees to a consumer who prevails. If the manufacturer appeals and the consumer prevails in court, the recovery includes attorney fees and court costs.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Georgia Lemon Law: The Rules That Decide a Valdosta Claim

Beyond the repair test and the arbitration rule, which are both in Court and Venue above, Georgia law has some provisions of its own.

Notable provisions of Georgia Lemon Law

Georgia requires the consumer to notify the manufacturer by statutory overnight delivery or certified mail, return receipt requested, once a reasonable number of repair attempts has been reached. The manufacturer then has 28 days to make a final attempt to repair. One repair attempt is sufficient for a serious safety defect. Trucks over 12,000 lbs gross vehicle weight rating, motorcycles, and golf carts are excluded.

Your Rights Under Georgia Law

What The Manufacturer Owes You

Georgia's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying Valdosta case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Georgia law and on the paperwork Valdosta drivers usually send us.

PROCESS & TIMELINE
Most of the Georgia cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Georgia, you must apply for state arbitration within 1 year after the lemon law rights period ends, or within 60 days after a certified manufacturer program's decision if that is later. The rights period is 2 years or 24,000 miles from delivery, whichever comes first.
Usually not. Most lemon law cases we handle for Valdosta drivers settle with the manufacturer before a lawsuit is filed. In Georgia, you must use the manufacturer's arbitration program first if it is state-certified. We prepare that filing for you.
ELIGIBILITY
Ga. Code §10-1-780 to §10-1-795 covers new motor vehicles purchased or leased in Georgia for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Georgia cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ga. Code §10-1-780 to §10-1-795 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. In Georgia, the state arbitration panel may award attorney fees to a consumer who prevails. If the manufacturer appeals and the consumer prevails in court, the recovery includes attorney fees and court costs. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”
