Atlanta Lemon Law Basics
In Atlanta, as anywhere else in Georgia, a lemon law claim is brought under Ga. Code §10-1-780 to §10-1-795. The statute covers new motor vehicles purchased or leased in Georgia for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Does the Defect Substantially Impair Use, Value, or Safety?
Under Georgia law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Georgia the test is 3 repair attempts for the same defect (1 for serious safety defects) or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Georgia, you must apply for state arbitration within 1 year after the lemon law rights period ends, or within 60 days after a certified manufacturer program's decision if that is later. The rights period is 2 years or 24,000 miles from delivery, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

Court and Venue in Atlanta
Parts of Atlanta lie in DeKalb County and Fulton County, per the 2020 Census. Their general civil trial courts are the Superior Court of DeKalb County (DeKalb Judicial Circuit) and the Superior Court of Fulton County (Atlanta Judicial Circuit). Georgia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Georgia lemon law is Ga. Code §10-1-780 to §10-1-795. If the manufacturer's arbitration program is state-certified, the consumer must use it.
The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The state arbitration panel may award attorney fees to a consumer who prevails. If the manufacturer appeals and the consumer prevails in court, the recovery includes attorney fees and court costs.

Georgia Lemon Law: The Rules That Decide an Atlanta Claim

Notable provisions of Georgia Lemon Law
Georgia requires the consumer to notify the manufacturer by statutory overnight delivery or certified mail, return receipt requested, once a reasonable number of repair attempts has been reached. The manufacturer then has 28 days to make a final attempt to repair. One repair attempt is sufficient for a serious safety defect. Trucks over 12,000 lbs gross vehicle weight rating, motorcycles, and golf carts are excluded.

What The Manufacturer Owes You
Georgia law provides for a replacement vehicle or a full refund, minus a reasonable offset for use. There are three ways a qualifying case from Atlanta usually ends.
Refund
Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.
Replacement Vehicle
The manufacturer hands you a comparable new car and pays the cost of the exchange.
Cash Settlement
The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.
