Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders, and we handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your Rhode Island claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Rhode Island claim gets built on two things: the Rhode Island lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Providence Lemon Law Basics
In Providence, as anywhere else in Rhode Island, a lemon law claim is brought under R.I. Gen. Laws §31-5.2-1 to §31-5.2-14. The statute covers new motor vehicles purchased or leased in Rhode Island for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Rhode Island Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.
How a Providence Lemon Law Claim Works
This is what happens after you call us from Providence.
Document Your Repairs
Keep every repair order from your Providence dealership, even the short ones. RI lemon law needs written proof of each repair attempt, and those papers are the proof.
Free Case Evaluation
We read your repair history against the Rhode Island statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including any written notice to the manufacturer that RI law requires. We deal with the manufacturer for you.
You Get Compensated
The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Have You Met the Repair Attempt Threshold?
In Rhode Island the test is 4 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Rhode Island the deadline is 3 years of original delivery or 2 years of the date the odometer reached 15,000 miles, whichever is earlier. We check it against the delivery date on your contract and the dates on your repair orders.

If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in Providence
Providence is in Providence County. Its civil trial court is the Rhode Island Superior Court. Rhode Island also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Rhode Island lemon law is R.I. Gen. Laws §31-5.2-1 to §31-5.2-14. The consumer must first use the manufacturer's qualifying procedure or the state motor vehicle arbitration board.
The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails is entitled to attorney fees.

Rhode Island Lemon Law: The Rules That Decide a Providence Claim
We covered the repair test, the arbitration rule and the deadline in the Court and Venue section above. Below are other Rhode Island rules that can matter to a Providence claim.
Notable provisions of Rhode Island Lemon Law
Rhode Island’s term of protection is 1 year or 15,000 miles from delivery, whichever comes first, and the presumption is 4 repair attempts or 30 cumulative calendar days out of service. A consumer who uses an informal dispute procedure is never precluded from later seeking the chapter’s remedies in court.

What The Manufacturer Owes You
Under Rhode Island law the remedy is replacement vehicle or full refund (minus reasonable use offset). A qualifying RI case from Providence usually closes in one of these three ways.
Refund
The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.
Replacement Vehicle
The manufacturer swaps your car for a comparable new one and pays for the exchange.
Cash Settlement
You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.
