How your Rhode Island claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Rhode Island claim gets built on two things: the Rhode Island lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

South Kingstown Lemon Law

South Kingstown Lemon Law Basics

In South Kingstown, as anywhere else in Rhode Island, a lemon law claim is brought under R.I. Gen. Laws §31-5.2-1 to §31-5.2-14. The statute covers new motor vehicles purchased or leased in Rhode Island for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Rhode Island Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a South Kingstown Lemon Law Claim Works

This is what happens after you call us from South Kingstown.

1

Document Your Repairs

Keep every repair order from your South Kingstown dealership, even the short ones. RI lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Rhode Island statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that RI law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your South Kingstown Car a Lemon? Rhode Island's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Rhode Island law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Rhode Island the test is 4 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Rhode Island the deadline is 3 years of original delivery or 2 years of the date the odometer reached 15,000 miles, whichever is earlier. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Washington County

Court and Venue in South Kingstown

South Kingstown is in Washington County. Its civil trial court is the Rhode Island Superior Court. Rhode Island also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Rhode Island lemon law is R.I. Gen. Laws §31-5.2-1 to §31-5.2-14. The consumer must first use the manufacturer's qualifying procedure or the state motor vehicle arbitration board.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails is entitled to attorney fees.

What the Statute Says

Rhode Island Lemon Law: The Rules That Decide a South Kingstown Claim

Looking for the repair test, the deadline or the arbitration rule? Those are under Court and Venue above. Rhode Island law has a few more rules, and they are listed here.

Notable provisions of Rhode Island Lemon Law

Rhode Island’s term of protection is 1 year or 15,000 miles from delivery, whichever comes first, and the presumption is 4 repair attempts or 30 cumulative calendar days out of service. A consumer who uses an informal dispute procedure is never precluded from later seeking the chapter’s remedies in court.

Your Rights Under RI Law

What The Manufacturer Owes You

Rhode Island law provides for replacement vehicle or full refund (minus reasonable use offset). There are three ways a qualifying case from South Kingstown usually ends under RI law.

$

Refund

Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.

Replacement Vehicle

The manufacturer hands you a comparable new car and pays the cost of the exchange.

$

Cash Settlement

The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Rhode Island law and on the paperwork South Kingstown drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your South Kingstown dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for South Kingstown drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Rhode Island rule is: must first resort to the manufacturer’s qualifying procedure or the state motor vehicle arbitration board. We prepare that filing for you.
ELIGIBILITY
It may. Under R.I. Gen. Laws §31-5.2-1 to §31-5.2-14, your South Kingstown car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Rhode Island for personal, family, or household use.
R.I. Gen. Laws §31-5.2-1 to §31-5.2-14 covers new motor vehicles purchased or leased in Rhode Island for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
REMEDIES
In Rhode Island, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Rhode Island, the manufacturer pays the consumer's attorney's fees when the consumer wins. In most successful Rhode Island claims, the manufacturer pays our fee. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

What Our Clients Are Saying

Easy Lemon has handled 1,500+ lemon law matters‡.

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
