A New York City car is judged against New York's statute, N.Y. Gen. Bus. Law §198-a, and that law covers new motor vehicles purchased, leased, or registered in New York (also has separate used car lemon law). So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. Under New York law, the defect has to substantially impair the vehicle's use, value, or safety.

Court and Venue in New York City

New York City is made up of five counties: Bronx, Kings (Brooklyn), New York (Manhattan), Queens and Richmond (Staten Island). The Supreme Court of the State of New York, the state's general civil trial court, sits in each of them. New York also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The New York lemon law is N.Y. Gen. Bus. Law §198-a. New York does not require certified-mail notice from the consumer in the ordinary case; reporting the problem to the manufacturer, its agent or its authorized dealer is enough (N.Y. Gen. Bus. Law §198-a(b)). If the manufacturer has its own dispute program, the consumer must use it first to get a refund or replacement. The state arbitration program is optional, and every manufacturer must take part if the consumer chooses it.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What The Manufacturer Owes You

New York law provides for replacement vehicle or full refund (minus reasonable use offset). There are three ways a qualifying case from New York City usually ends under NY law.

Refund

Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.

Replacement Vehicle

The manufacturer hands you a comparable new car and pays the cost of the exchange.

Cash Settlement

The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.

PROCESS & TIMELINE

Bring the repair orders from your New York City dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.

ELIGIBILITY

It may. Under N.Y. Gen. Bus. Law §198-a, your New York City car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased, leased, or registered in New York (also has separate used car lemon law).
