How your Hawaii claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Hawaii claim gets built on two things: the Hawaii lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Kailua Lemon Law

Kailua Lemon Law Basics

A Kailua car is judged against Hawaii's statute, Haw. Rev. Stat. §481I-1 to §481I-4, and that law covers new motor vehicles purchased or leased in Hawaii for personal, family, or household purposes. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Hawaii Lemon Law Attorneys page.

Step by Step

How a Kailua Lemon Law Claim Works

This is what happens after you call us from Kailua.

1

Document Your Repairs

Keep every repair order from your Kailua dealership, even the short ones. Under Hawaii's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Hawaii statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Haw. Rev. Stat. §481I-1 to §481I-4

Is Your Kailua Car a Lemon? Hawaii's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Hawaii law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Hawaii the test is 3 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Hawaii, a claim must be filed within 1 year after the lemon law rights period ends. The rights period is the express warranty term, 2 years, or 24,000 miles from delivery, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Honolulu County

Court and Venue in Kailua

Kailua is in Honolulu County. Honolulu County's general civil trial court is the Circuit Court of the First Circuit. Hawaii also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Hawaii lemon law is Haw. Rev. Stat. §481I-1 to §481I-4. The consumer may go directly to court or use voluntary arbitration.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Fees come through the state certified arbitration program: the prevailing party, consumer or manufacturer, may be allowed reasonable attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Hawaii Lemon Law: The Rules That Decide a Kailua Claim

Looking for the repair test or the arbitration rule? Those are under Court and Venue above. Hawaii law has a few more rules, and they are listed here.

Notable provisions of Hawaii Lemon Law

Hawaii counts business days for out-of-service calculations. The law also covers motor vehicles used for short-term rentals, and it provides for potential treble damages for manufacturer bad faith.

Your Rights Under Hawaii Law

What The Manufacturer Owes You

Under Hawaii law the remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. A qualifying case from Kailua usually closes in one of these three ways.

$

Refund

The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.

Replacement Vehicle

The manufacturer swaps your car for a comparable new one and pays for the exchange.

$

Cash Settlement

You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.

Have Questions?

Frequently Asked Questions

The answers below are based on Hawaii law and on the paperwork Kailua drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Kailua dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Kailua drivers settle with the manufacturer before a lawsuit is filed. In Hawaii, arbitration is not required. You may go directly to court or use voluntary arbitration.
REMEDIES
Under Haw. Rev. Stat. §481I-1 to §481I-4, the remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Which one you get depends on your repair history and on what the manufacturer offers.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Hawaii cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Haw. Rev. Stat. §481I-1 to §481I-4 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. In Hawaii, fees come through the state certified arbitration program: the prevailing party, consumer or manufacturer, may be allowed reasonable attorney fees. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
